We
have
kind
of
a
two-part
of
one
topic
agenda
today,
so
we
are
going
to
be
discussing
the
city
attorney's,
as
well
as
giving
authorization
to
the
staff
to
advertise
or
to
begin
to
advertise
for
the
position
of
city
attorneys.
Would
you
like
to
have
an
update.

Yes,
I
would
thank
you
mayor
as
a
refresher
for
council
on
march
31st
council
adopted
resolution
2081-2021,
which
started
the
process
for
termination
of
the
city
attorney
for
cause
within
that
ordinance
was
also
the
requirement
that
we
followed
the
requirements
of
the
city
charter
for
the
termination
process
and,
as
such,
mr
ambrosio
was
advised
of
the
financial
obligations
that
the
city
had
to
only
up
to
the
point
of
termination
that
30-day
window,
the
ordinance
or
the
resolution
also
asked
the
city
to
reach
out
to
mr
ambrosio
to
see
if
there
could
be
an
alternate
resolution
to
the
situation
we
utilized
our
attorney
when
we
finally
found
out
that
he
was
legally
represented
and,
as
of
april
7th,
the
city
did
receive
a
email
communication
that
was
stipulating
mr
ambrozio's
resignation,
which
would
be
effective
immediately,
but
conditioned
upon
payment
of
the
accrued
leave
based
salary
and
employee
benefits.

So
staff's
recommendation
with
regards
to
his
resignation
is
that
we
accept
that
resignation
with
the
terms
and
conditions
that
stipulated,
and
that
would
mean
that
his
termination
is
effective
immediately.
The
second
part
which
we've
also
rolled
into
the
same
motion,
is
to
allow
the
city
staff
to
begin
the
process
of
advertising
for
the
city
attorney
position.
We
have
two
documents
that
are
in
front
of
you
and
a
few
parts
that
we
just
wanted
to
call
to
your
attention.

This
is
a
markup
of
the
brochure
that
we
did
from
two
years
ago
when
we
started
the
process
of
hiring
for
the
city
attorney,
and
you
also
have
a
detail
of
the
job
description
that
goes
along
with
it.
The
job
description,
which
is
the
more
basic
document
that
you
see.

We
wrote
in
part
of
the
experience
requirements
as
minimum
of
10
years
experience
in
municipal
law
or
five
years
experience
specifically
in
florida,
local
government
practice.
Therefore,
you
could
have
someone
who's
applying
say
from
the
state
of
georgia,
where
maybe
they've
been
an
assistant
city
attorney
or
city
attorney
for
10,
15
or
20
years.
They
would
meet
that
minimum
10-year
qualification
here
in
the
state
of
florida.

As
long
as
they've
been
involved
in
local
government
law,
at
least
for
five,
that
will
make
them
eligible
and
then
finally,
on
the
actual
brochure
itself,
if
you
look
under
compensation
and
benefits
knowing
what
is
being
paid
in
summer,
some
of
our
neighboring
jurisdictions
under
compensation
and
benefits,
we
took
that
range
which
had
been
125
to
145
and
we
have
broadened
it
to
125
to
155
depending
upon
qualifications.

So
staff's
recommendation
tonight
is
that
you
accept
the
resignation
from
the
from
mr
rambrosio
and
his
resignation
would
then
be
effective
immediately
and
then
provide
staff
authorization
to
start
with
the
advertisement
process.
It
would
be
our
intention
at
the
april
26
council
briefing
that
we
would
have
the
conversation
with
council
as
to
what
the
screening
criteria
and
interview.

accept

city
attorney's
resignation
effective,
immediately
conditioned
upon
payment
of
the
accrued
leave,
base,
salary
and
employee
benefits,
as
outlined
in
the
letter
and
notice
to
mr
ambrosio
dated
april

2021

to
advertise
for
the
position
of
city
attorney.

financial
impacts

they're
not

the
packet
and

feel
like
we

at
least
just

the
discussion

the

for

mr
stokes,
you
asked
about
financial
impact
at
the
original
meeting,
the
first
special
counsel
meeting
that
we
had.

believe
we
discussed
some

of
the
parameters
in
that
the
special
I
mean
the
impact
of
the
pay,
depending
on
what
we
where
we,
where
we
landed
so
given
that
we
have
already
paid
in
the
last
payroll
we
paid
for
mr
ambrosio
hours,
worked
and
then
base
pay
for
the
entire
two-week
pay
period,
and
we
paid
auto
allowance
florida
bar
certification
and
insurance
supplement
and
the
retirement
opt-out
contribution
through
april
1st.

So
for
the
next
two
pay
periods,
which
will
take
us
through
the
end
of
april,
payable
the
last
pay
period
payable,
may
7..
Those
two
pay
periods
will
include
base
pay
only
without
any
of
the
special
plant
pays,
but
we
are
also
including
health
insurance,
dental
insurance,
life
insurance
and,
of
course,
medicare
and
social
security
benefit.

So
for
the
three
pay
periods,
which
is
a
six
week
period
to
take
us
through
the
end
of
april,
the
total
pay
compensation
and
benefits
is
22
246
dollars.

And
I
just
want
to
point
out
the
arrangements
that
you
all
agreed
to
in
the
last
meeting
was
was
to
pay
the
base
pay
through
the
end
of
the
month
and
benefit
through
the
end
of
may.
The
agreement
that
mr
ambrosio
has
requested
does
not
change
the
base
pay
or
the
payout
numbers
at
all.

one
question
for
the
city
on
that.

stepopoulos,
are
we
going
to
be
hiring
a
third
party
for
the
hiring
of
a
new
attorney.

was
not
our
intention
to
hire

party
when
we
did
this.
Last
time
we
received,
I
believe,
15
to
20
applications.
In
total,
there
were
six
that
minimum
qualifications,
five
that
were
ultimately
chosen
by
council
to
bring
in
for
interviews
and
then
council
did
their
interview
process
at
april
26.

that
I
see
us
needing
to
bring
somebody
in
for
is
the
actual
contract
negotiation,
because
we
had
a
lawyer
do
that.
That
lawyer
happened
to
be
on
council
the
last
time,
so
the
actual
contract

accepting

resignation

through

terminating

making

termination

gives
us
the
opportunity
to
go
ahead
and
get
that
job
on
the
market

this
body
hires
and
fires,

say

we
could
all

these
documents

maybe
providing

we
have

recently
restructured
this,

city
attorney
position

go

an
in-house
city
attorney.

council
members

to
give
them
a
chance
to
look
through
everything,
