Regular meeting of the City of Palm Springs Administrative Appeals Board, held December 28th, 2022
A
So
everybody's
been
notified.
These
are
recorded
good
evening
everybody.
My
name
is
Mike
Vanessa
I'm,
the
chair
of
the
administrative
appeals
board.
I,
hereby
call
the
regular
meeting
of
the
administrative
appeals
board
for
December
28th
2022
to
order
board
secretary.
Could
you
please
conduct
the
Roll
Call.
B
A
E
A
A
Anybody
that
wishes
to
speak
will
be
allowed
three
minutes
and,
although
the
board
values
your
comments,
pursuant
to
the
brown
act,
this
board
generally
cannot
take
any
action
on
any
item
not
listed
on
the
posted
agenda.
Testimony
for
the
hearings
will
be
heard
and
taken
at
the
time
of
each
particular
hearing
board
secretary.
Is
there
anyone
that
is
requested
to
speak.
A
But
nobody
for
public
comment
yeah
great!
Thank
you
all
right,
so
we
will
start
with
our
first
case.
Next
item
is
number
three
on
the
agenda:
the
appeal
of
the
permanent
ban
and
administrative
fine
dollars
concerning
360
West
Pico
Road
LLC
at
360,
West,
Pico,
Road
board
secretary.
Could
you
please
ensure
that
City
staff
and
the
understand
that
their
testimony
is
under
a
vote.
B
A
Correct
at
this
time
with
the
city
would
like
to
present
their
report.
F
Yes,
thank
you,
chair
board
members,
City
staff,
public
and
joining
us
with
the
Department
of
special
program
compliance
and
we
oversee
the
vocational
program
here
in
city
of
Palm
Springs
before
you
this
evening
is
Staff
report
for
the
property
located
at
360,
West
Pico
Road.
Here
in
Palm
Springs,
it
was
found
that
this
property
was
operating
as
a
vacation
rental
without
a
vacation
one
of
their
registration
certificate
and
it's
an
administrative
citation
was
issued
on
October
21st
2022.
F
in
the
staff
report.
It
shows
the
elements
but
officers
to
find
the
proposed
violations
and
we
do
have
code
supervisor
nav
hand.
That
is
here
this
evening
represent
a
statement.
The
code
officer
that
did
investigate
this
property
is
out
on
holiday
this
evening.
So
I
would
like
to
call
code
officer,
super
code,
supervisor,
foreign.
F
Right
so
I'll
go
ahead
and
read
that
statement
also
be
available
for
General
employees.
If
you
have
any
follow-up
questions
that
are
not
specific
to
this
circumstance
that
can
provide
information
but
to
help
them
conduct.
Our
investigations
in
general
General
following
statement,
is
on
October
21st
2022
I
was
streaming
on
how
we
search
for
legal
Fortune,
rentals
on
air
on
the
website
Airbnb
when
I
came
across
an
advertisement
that
did
not
include
the
registration
certificate
number
in
the
Albert
Jackson,
as
this
is
a
key
indicator
of
illegal,
unregistered,
short-term
rentals.
F
F
And
didn't
see
any
registration
in
the
address
I
contacted
the
advertiser
to
get
more
information
regarding
the
rental
and
the
conference
being
running
on
a
short-term
basis,
I
was
able
to
confirm
booking
for
three
nights
from
December
16
to
2022
to
December
19
2022
without
a
valid
short-term
rental
certificate.
This
is
a
violation
of
PSNC,
525
or
90c
classification.
F
Operating
educational
authorification,
registration
certificate,
I
issued
administrative
citation,
ab0411
owner
of
a
property
and
mailed
to
address
on
file
and
then
just
not
part
of
statement,
but
it's
also
a
violation
525
or
40,
which
requires
you
to
have
application
around
registration
certificate
in
order
to,
on
a
short-term
basis
of
less
than
20
years.
F
Yeah,
525
or
97
just
talks
about
the
increased
fine
amounts
in
the
violation
specific
to
Vacation
roles.
So
that's
that
was
a
statement
from
a
master
way
and,
like
I,
said
I'm
available.
A
F
From
the
city
yes
chair,
thank
you
just
additionally,
in
the
staff
report,
you'll
see
a
background
section.
We
did
our
department
a
special
program.
Compliance
did
receive
a
completed
application
for
this
property
for
a
vacation
rental
certificate
on
August,
11
2022,
and
that
application
was
in
process
on
September
26.
F
A
code
officer
did
complete
a
safety
inspection
which
is
harder,
the
application
processing
for
a
safety
certificate
or
a
vacation
rental
registration
certificate
and
then
on
October
21st
is
when
that
citation
was
issues
for
operating
without
that
certificate
on
that
certificate
was
not
issued
prior
to
the
violation,
and
it
has
not
been
issued
since.
A
A
At
this
time,
we'll
open
it
up
to
questions
from
the
board
to
the
city.
Why
don't
we
start
with
Mr
Hedrick.
A
Just
for
my
understanding
they
had
applied
for
a
permit
during
the
process
is
when
they
got
this
citation,
and
that's
why
the
permit
was
not
issued.
That's
correct,
okay
and.
A
Okay,
so
all
right,
so
if
there's
no
more
questions
for
the
city
at
this
time,
I'd
like
to
open
the
appeal
hearing,
the
appellant
will
be
invited
to
speak
for
up
to
10
minutes.
Any
members
of
the
public
who
desire
to
speak
on
this
particular
appeal
hearing
shall
have
up
to
three
minutes
to
speak.
If
any
member
of
the
public
chooses
to
testify,
the
appellant
will
be
invited
to
provide
a
rebuttal
for
up
to
an
additional
two
minutes
board
secretary.
Could
you
please
begin
the
public
testimony
period.
B
A
Yes
and
go
ahead,
you
have
10
minutes.
H
H
That
I
try
to
to
reschedule
and
I
would
like
to
be
in
person,
but
you
know
I
was
not
able
so
I'm.
So
sorry,
if
there
is
a
bit
of
noise
here,
I'm
Charlie
I'm,
the
leader
of
something.
So
the
thing
here
is
that
I'm,
you
know
obviously
I'm
the
owner
of
the
property,
so
I
apply
for
for
the
license
right
and
in
the
meantime,
I
have
I
had
a
tenant
and
I
have
Lieutenant.
That
is,
you
know,
placing
the
property
I
have
a
list
with
her,
and
you
know.
H
So
pleasing
the
property,
without
my
consent,
I,
have
seen
you
know
the
the
documents
on
because
I'm
in
the
middle
of
the
deviation
right
now
at
this
moment.
But
basically
you
know
she
was
releasing
the
the
property
with
a
mouse
of
my
consent
and
as
soon
as
I
noticed
inside
you
know,
I
started
everything.
H
I
conducted
the
city
as
well,
and
you
know,
I
was
super
surprised
of
this
situation.
I
think
it's
gonna
be
she's
gonna
be
gone
by
January.
You.
H
At
this
point,
everything
is
in
in
the
process
right
now,
and
my
daughter
is
dealing
with
this
situation,
and
yeah
at
this
moment
is
like
I,
don't
know
what
else
I
can
do
like
I,
don't
know,
I
think
that
I
think
because
I
sent
several
emails
and
I
try
to
call
like
there's
a
ghost
from
this
ago,
but
I
think
that
you
received
the
the
last
email
that
I
sent
and
the
comments
and
everything
and
yeah.
Basically,
this
is
the
situation
for
me
right
now.
It.
I
H
Not
aware
because
the
thing
is
that
when,
when
I
apply,
okay
for
the
license
and
so
on,
I
go
so
I
pass.
The
inspection
and
I
was
just
waiting
for
for
the
permit
and
in
the
meantime,
this
this
girl
wants
to
place
in
the
property
and
I
was
not
aware,
because
you
know,
as
I
received
an
email
that
I
passed,
the
inspection
and
so
on,
and
everything
should
be
fun.
So
it
was
supposed
to
be
fine.
E
H
J
H
I,
don't
know
what
else
I
can
do,
but
yeah
the
only
thing
I
want
is
to
pick
out
this
tenant
from.
H
A
All
right,
thank
you.
Is
there
anybody
else
that
had
requested
to
speak
on
this
hearing?
No
okay!
Thank
you!
Okay!
Gonzalez!
If
there's
nothing
further
from
you
at
this
point,
we'll
open
it
up
for
board
members
to
ask
you
questions:
why
don't
we
start
with
Mr
Hedrick.
G
H
That's
correct,
so
the
list
that
I
have
with
her
is
a
three
month
list:
okay,
possibly
to
renewal
for
a
month
to
month.
But
the
plan
was
that's
your.
She
was
gonna,
be
there
for
three
months:
okay
and
in
the
meantime,
yeah
I
applied
for
my
license
and
and
she
was
publishing
the
property.
Without
my
permission.
Yes,.
H
H
G
H
Yes,
I
did
I,
didn't
expect
her
everything
but
I
had
to
explain.
You
know
that
I
had
an
infection
and
something
like
that,
but
you
know
I
didn't
explain
the
reason
about
that,
but
no
actually.
G
So
for
the
city,
who
did
you
get
a
response
from
when
you
when
there
was
a
attempt
to
do
a
rental
in
December.
A
Before
you
answer
that,
can
I
ask
one
question:
why
you're
looking
Mr
Gonzalez?
Can
you
tell
us
the
name
of
your
tenants.
F
Oh
yeah,
it
looks
like
put
officer
weight
made,
an
inquiry
and
amarisa
responded,
invited
him
to
complete
booking
or
two
guests
between
December
16th
and
19th.
D
C
H
D
H
A
All
right,
okay,
so
this
might
be
reiterating
some
of
what
Mr
Hedrick
asked,
but
so
your
tenant
was
there
for
how
long.
H
H
And
because
it
was
on
December
15th,.
A
So
are
you
in
the
process
of
evicting
her?
Is
that
what
I
heard
all
right?
That's
correct!
Yes,
okay,
all
right,
I,
don't
think
I
have
any
other
questions.
Anybody
else
have
anything
else.
They
would
like
to
ask
Mr
Gonzalez
all
right,
so
we'll
close
the
public
portion,
the
next
portion
will
be
discussion
amongst
the
board.
D
F
E
F
Also
agree
with
you
on
that
I
think
it's
kind
of
hard
to
penalize
someone
for
something
that
another
person
is
doing
without
their
knowledge.
So
it's
kind
of
hard
I
know
that
we
had.
We
went
with
legal
counsel's
comment
that
it
is
the
responsibility.
Ultimately,
the
responsibility
of
the
of
the
owner
of
the
property,
but
I
also
have
a
problem
with
that,
because
how
do
we?
How
can
we
penalize
someone
for
something
that
someone
else
is
doing
without
their
knowledge,
so
I'm,
just
kind
of
I'm
kind
of
mixed
about
that
as
well?
F
My
I
understand.
E
F
G
I
agree
with
Mr
Moses
and
Mr
macelli,
and
during
the
commissioner's
comments,
I
will
bring
up
some
other
issues
regarding
this.
Thank
you.
A
A
I
mean
we've
been
counseled
that
you
know
the
ordinance
is
pretty
clear,
regardless
of
who
does
it?
It's
the
homeowner,
that's
responsible,
but
you
know
being
human,
it's
hard
to
to
just
kind
of
turn
a
blind
eye
yeah
when
somebody
at
least
appears
that
they
were
trying
to
follow
the
correct
steps
and
getting
a
permit.
All
of
that
so.
H
A
I
A
A
tough
one,
you
know,
there's
the
letter
of
the
law
and
then
the
you
know,
kind
of
a
interpretation
of
it.
I
guess
go.
C
Ahead,
yeah,
I
I.
Don't
think
that
this
is
the
letter
of
the
book
and
I.
Think
if
you
ask
legal
counselor
this
set
of
events,
he
would
have
agreed
that
the
owner
was
not
level
the
owner
with
a
lease
of
30
days
or
more
gives
up
the
rights
of
the
owner
for
that
period
of
time.
So
he
is
technically
not
able
to
act
as
owner
during
that
period
of
time
the
tenant
is
the
tenant
is
the
one
who
should
be
punished.
F
Yeah
I'd
be
happy
to
yeah,
so
in
this
situation,
I
think
it.
Unfortunately,
if
you
review
the
memo
that
legal
counsel
sent
and
based
on
my
comments
last
time,
I
do
still
believe
that,
in
terms
of
the
strict
letter
of
of
the
municipal
code,
there
is
no.
There
is
no
really
knowledge
or
consent
required
by
the
property
owner,
but
the
various
code
sections
you
know
made
clear
that
any
operation
of
the
other
vacation
rental
without
a
registration
certificate
is
prohibited
regard,
and
they
don't
require
that.
F
You
know
an
owner
be
aware,
or
can
say,
of
course,
I
understand
the
position
that
the
court
is
in
with
respect
to
that.
But
in
terms
of
what
the
code
says
that
that's
what
that
it
is
what
it
says
so,
unfortunately,
I
don't
think
that
that's
correct
I,
think
you
know
there
may
be
a
situation
in
which
you
know
somebody
can
have
separate
recourse
outside
you
know.
Perhaps
this
property
owner
might
have
the
course
against
the.
C
F
With
respect
to
their
actions
and
made,
certainly
they
can
explore
those
options,
but
in
terms
of
applying
the
code
itself,
it
does
seem
that
the
code
doesn't
pose
strict
liability.
J
For
the
operational
vacation
rental,
without
a
certificate
so-
and
you
know-
I've
reviewed
the
sections
again
there.
F
Hasn't
been
any
changes
since
our
last
meeting,
so
I
I
maintain
that
that's
what
that's
my
opinion,
that
no
knowledge
or
consent
is
required.
D
I
asked
to
see
so
I
completely
understand
when
the
attempt
by
the
city
to
to
rent
the
property
who
replied
to
it
was
it
the
tenant
replied
to
the
owner.
F
So
from
an
understanding,
the
owner's
name
and
then
who
the
owner
mentioned,
he
was
the
tenant.
That
name
does
not
match.
I
mean
it
was
a
hit
on
the
Ritz
I
believe
I
said
who
replied
on
the
address,
and
it
does
not
appear
from
the
accountants
testimony
that
that
was
the
tan
foreign.
A
F
Does
show
on
the
advertisement
that
we
have
the
advertisements
of
five
star
or
10
reviews
from
October
2022
and
the
last
one
that
we
saw
in
the
package
shows
September,
2022.
F
and
just
kind
of
looking
over
the
reviews
from
the
guests
that
stay
in
the
property.
There
are
no
other
names
mentioned
other
than
Maritza.
C
A
But
the
way
the
ordinance
is
written,
it
states
the
owner
whether
they
are
somebody
else
has
tenant
rights.
The
ordinance
refers
to
the
owner.
Now.
What
you're
saying
is
that
you
know
with
a
a
lease.
Somebody
else
has
those
rights,
but
the
ordinance
is
that
the
owner
is
still
accountable
because
I
guess
you
know
I
don't
want
to
put
words
in
your
mouth,
but
this
City's
perspective
is
they
have
to
hold
somebody
accountable,
and
the
city
is
chosen
that
the
owner
is
accountable.
A
Gonzalez
that
can
you
do
you
know
who
this
Marisa
I'm,
not
sure.
If
I'm
saying
it
correctly,.
D
H
A
H
Have
no
idea,
the
thing
is
that
here
is
that
how
how
can
I
know
you
know
it's
impossible
for
me
to
know
to
to
knew
this,
like
you
know,
if
I
then-
and
there
is
like
you
know,
to
have
a
normal
person
living
in
there
and
and
that's
it
I
cannot
have
control.
H
C
D
H
I
started
all
the
all
the
eviction
process
and
everything
and
I
was
at
least
then
and
to
to
read
on
like
to
be
gone
as
soon
as
possible.
But
for
me
was
impossible
to
do
something
because
I
was
not
aware.
How
can
I
do
something?
You
know
what
I
mean?
That's,
that's
the
that's
the
situation
here,
the
name
I,
don't
know
I,
don't
know
the
like
the
name
that
she
was
using
or
I
have
no
idea.
H
But
the
thing
here
is
that,
like
I'm,
this
situation
is
is
so
much,
but
the
point
here
is
that
I
cannot
have
control
about
a
life
it's
impossible
for
me
to
know
like
what
do
you
want
me
to
like
take
check
the
listings
or
go
to
the
property
and
check
what
she
was
doing
and
so
on
like
I,
cannot
do
that?
I
cannot
do
that
like
I,
don't
understand
what
else
I
can
honestly.
A
A
Yes,
my
question
would
be
is
when
was
the
application
for
the
permit
done
or
submitted,
so
the
application
was
submitted
in
August.
A
F
Fair
yeah,
the
citation
was
issued
before
their
registration,
okay,
yes,
the
citation
is
issues
but.
A
The
application
was
done
well
in
advance
of
that,
of
course.
Okay,
all
right,
any
more
comments.
C
Yeah
I,
just
don't
read
this
memo
as
intending
to
be
quite
that
extreme.
It's
talking
about
Associates
of
the
owner,
who've
done
things
is
not
talking
about
a
tenant
who
has
perceived
a
transfer
of
the
control
and
tenant.
Did
the
wrongdoing
not
I,
don't
know
why
the
tenant
wasn't
cited,
but
the
tenant
did
the
wrong
group
not.
C
C
A
That's
the
way
they
wrote
it,
whether
it's
right
or
wrong
is
not.
You
know
for
us,
it's
it's
the
way
they
wrote
it
that
the
city
holds
the
owner
accountable.
J
If
I
could
ask,
would
it
would
this
situation
be
the
same
if
the
the
owner.
F
F
F
You
know
for
violations
of
the
tenant
that
give
rise
to
something
like
this,
but
unfortunately-
or
you
know
not,
unfortunately,
but
just
in
terms
of
factually
the
way
that
the
the
awareness
is
written
right
now,
you
know
there
is
no
distinction
between
you
know
an
owner
that
has
a
tenant.
That
is
aware
that
this
is
prohibited
or
not.
You
know,
of
course,
an
owner
might
take
those
precautions
to
avoid
a
violation,
especially
in
light
of
the
strict
liability
that
the
code
enforces.
F
It
poses
right
now,
but
that's
how
it's
written
at.
E
C
F
And
not
intimately
aware,
but
but
you
know,
noise
regulations
at
the
city,
so
I
don't
I,
because
my
opinion
is
based
solely
on
the
text
of
the
code
with
respect
to
Vacation
Rentals
and
the
operation
of
education
and
all
without
a
certificate.
That's
what
my
opinion
is
limited
to
I
it
would
depend
on
you
know
the
attacks
of
the
code
with
respect
to
North.
You
know
regulation
violations,
you
know
so
I
can
imagine
that
you
know
the
pope
could
say
something
like
you
know:
a
property,
accountancy
business
level.
F
That
way,
so
I
can't
really
apply
without
knowing
it
to
Texas.
I
can
only
appoint
with
respect
to
the
text
of
the
vacation,
rental
ordinance
and
that
text,
you
know
specifically
says
you
know.
For
example,
you
know
in
the
memo
that
I
sent
some
specific
code
sections
and
what
they
say
and
you'll
see
that
you
know.
A
Good
sorry,
the
member
of
the
city
staff
has
a
something
that
so
our
practice
of
an.
F
Instance
of
an
active
disturbance,
so
whether
it's
an
issue
of
Music
being
played
that
can
be
heard,
Beyond
property
lines
or
too
many
vehicles.
The
reason
that
those
citation
citations
get
issued
to
the
responsible
person,
not
the
owners,
that
our
operating
requirements
require
that
each
owner
enters
into
a
contract
with
a
responsible
person,
and
so
as
part
of
that
process,
they
have
to
sign
a
statement
of
rules
and
regulations
which
acknowledges
that
they've
reviewed
a
good
neighbor
brochure
and
they're
going
to
adhere
to
the
rules
that
are
also
establishes
liability.
F
If
there
are
any
violations
of
those
specific
rules
outlined
in
the
Good,
Neighbor
sure
that
it
would,
they
would
be
held
accountable,
so
that
responsible
person
is
the
person
that
enters
into
the
contract
with
the
owner
and
they're,
ultimately
responsible
for
any
of
their
guest
Behavior
at
the
property.
So
that's
the
so
that's
why
a
music
complaint
or
too
many
vehicles
or
too
many
occupants
would
be
issued
to
the
responsible
person
and
not
to
the
property
owner.
F
Now
there
are
still
you
know,
penalties
that
get
levied
onto
their
own
in
the
form
of
an
infraction,
and
that's
when
we
see
them
here.
If
there's
three
factors
within
a
12-month
period,
their
property
would
get
suspended.
So
there's
that
accountability
side
to
hold
the
owner
responsible
as
far
as
creating
that
disturbance,
because
the
owner's
not
on
property
playing
the
music,
that
citation
does
go
to
the
responsible
person.
F
I
J
I
H
H
And
it's
very
clear
that
says
in
the
list
that
she
cannot
replace
the
property.
Okay,
if
she
does
I
think
what
I
think
is
that
my
only
my
only
option
is
go
against
her
and
that's
what
I'm
doing
right
now,
but
because
that
because
she's
doing
something
without
my
permission,
I
don't
think
I
should
be
fine
and
I
should
be
in
this
situation.
H
H
A
All
right,
thank
you
and
finally,
Mr
Hedrick
did
you
have
a
comment.
G
So
I
make
a
motion
that
we
overturn
the
the
band
and
the
five
thousand
dollar.
Fine
and
I
will
explain
during
commissioner
comments.
Why
I'm
making
the
motion
this
way,
but
I
am
making
that
motion.
G
B
A
Right,
thank
you,
everybody!
So
Mr
Gonzalez,
you
won
your
appeal.
The
city
will
be
contacting
you
in
a
more
official
capacity
soon.
I
want
to
thank
everyone
for
their
time
and
effort.
On
this
case,
and
now
we
will
move
on
to
the
next
case.
C
I'd
like
to
ask
Council
to
check
with
the
corporate
accounts,
whatever
we
call
the
overall
demand
you
work
for
if
this
fact,
if
it
was
under
at
least
two
or
third
party,
whether
the
owner
would
still
be
a
lot
I'd
like
an
opinion
from
it.
It's
a
supplement
to
this
opinion.
A
You
all
right
we're
gonna
move
on
to
the
next
case.
Next
item
is
number
four
on
the
agenda.
It
concerns
the
property
of
2600,
East,
vincentia,
Road
and
the
it
is
an
appeal
of
the
five
thousand
dollar
fine
and
an
administrative
decision
that
suling
Tian
I
just
apologize.
If
I'm
not
saying
that
correctly
is
permanently
ineligible
to
operate
a
vacation
rental
in
the
city
of
Palm
Springs
board
secretary,
could
you
please
ensure
that
the
city
staff
and
the
appellant
understand
that
their
testimony
is
under
oath.
B
B
A
You
the
city,
would
like
to
present
their
report.
F
Yes
good
evening,
thank
you
chair
our
board
members
and
City
staff
public
here
joining
us
this
evening.
My
name
is
Patrick
Clifford
with
the
Department
of
special
programs
and
Science,
and
we
oversee
the
vocational
program
here
in
the
city
of
Palm
Springs
before
you
this
evening
is
a
staff
report
regarding
the
property
located
at
2600,
East
vincentia
Road.
F
Here
in
Palm
Springs,
it
was
found
that
this
property
did
not
hold
a
lot
of
vacation
rental
registration
certificate
and
was
found
by
a
code
compliance
officer,
chicken
operating
as
one
and
a
citation
was
issued
on
April
21st
of
2022
and
the
code
officer
that
did
the
investigation
officer.
Williams
is
in
attendance
with
us
this
evening.
I
would
like
to
invite
him
up.
Additionally,
there's
some
background
in
your
staff
report
that
does
mention
that
our
office
did
receive
an
application
on
April
19th
2022.
F
However,
this
application
was
missing
some
material
and
was
rejected
and
sent
back
to
the
appellant
and
then
or
the
owner
of
the
property
and
at
on
April
21st.
Additionally,
citation
ab0380
was
issued
for
the
violation
found
on
April,
19th,
2022
and
again
I
would
invite
officer
Williams
for
his
Testament.
Thank
you.
F
Office
staff
then
forwarded
the
advertisement
to
me
to
follow
up
and
investigate
on
April
19th
I
sent
a
booking
entry
to
the
host
which
is
attached
attachment
8
in
your
packet.
The
booking
inquiry
was
for
August
11th
to
August
16
2022
for
six
steps
in
the
inquiry
I
asked
if
the
house
was
available
from
August
11th
to
16th,
as
my
family
would
be
heading
to
Palm
Springs
for
parents
50th
wedding
anniversary
shortly
thereafter
a
response
was
received.
It
said,
thank
you
for
your
interest.
F
The
house
was
available
and
it
was
signed
by
Brandon,
even
though
the
picture,
the
name
of
the
picture
said
Saga
s-a-g-a-h-
for
the
host
I
then
wrote
back,
because
I
wanted
to
make
sure
I
was
dealing
with
a
person
in
an
automated
system.
Thank
you.
So
much
I
will
be
booking
it
as
soon
as
I
get
home
from
work
this
evening
is
the
full
gate
additional
and
will
it
even
be
needed
in
August?
Please
let
me
know
and
also
any
restaurant
suggestions.
You
may
have
30
minutes
later.
F
At
that
time,
I
issued
a
citation
380
to
the
property
owner.
It
should
be
noted
that
the
property
reviews
indicate
there
have
been
renting
at
the
property
in
some
short
term.
A
review
from
you,
Chan
from
April
2022,
States
Michael.
The
host
checked
in
on
them
daily
during
their
two
days
stay
a
review
from
Iris
in
May
of
2022
States
I
enjoyed
our
stay.
It
was
a
perfect
weekend.
Getaway.
F
C
F
Appeal
in
the
of
the
island
invitates
that
they
listed,
they
put
the
ad
up
themselves
and
they
also
indicate
that
they
removed
the
ad
the
second
they
received,
the
citation
which,
just
to
let
you
know,
the
advertisement
is
still
active
and
that.
A
All
right,
why
don't
we
start
with
Mr
Sinclair?
If
you
have
any
questions
for
the
city,
I'm,
sorry,
the
city
have
anything
else
to
add
nothing.
F
J
Silly
just
a
quick
question:
when
the
application
was
returned
to
the
applicant.
F
I
have
a
letter
for
me
here.
It
does
list
Which
documents
that
they
needed
to
complete
and
submit,
but
that
does
not
show
any
information
that
they
can't
rent
at
this
time.
So
it
does
not
state.
E
E
A
Questions,
thank
you
all
right,
so
something
you
touched
on
towards
the
end
of
your
testimony.
So
at
the
time
of
the
citation
which
was
the
19th,
there
were
five
reviews
correct
and
as
of
now,
there
are
19.
As
of
the
last
time,
I
checked,
which
was
a
few
days
ago.
There
were
19.,
okay
and
you
just
said
I
think
you
just
said
the
ad
is
still
up
correct.
Okay
and
you
know,
when
you
checked
and
saw
that
it
was
still
up.
Is
it
still
up
zero
minimum
nights.
A
Foreign
all
right,
any
more
questions
for
the
city.
A
F
Ahead,
I
do
want
to
clarify,
though,
in
our
application,
where
the
owner
does
sign,
if
that
state,
that
they
are
not
authorized
to
advertise
or
otherwise
operate
a
vacation
rental
until
you
receive
specific
written
authorizations
from
our
department
and
that
administrative
clients
I'm
handling,
these
will
apply
and
that's
in
the
application
for
that.
In
the
letter
that
was
great.
F
If
they
will
only
literally
try
to
do
that
to
themselves,
if
our
finance
department
does
not
have
a
tax
member
permit
to
assign
that
to,
but
as
far
as
if
the
violation
is
found
on
valid
and
upheld,
what
could
happen?
A
Okay,
at
this
time,
I'd
like
to
open
the
appealed
hearing,
the
appellant
will
be
invited
to
speak
for
up
to
10
minutes.
Any
member
of
the
public
who
desires
to
speak
on
this
particular
appeal
hearing
shall
have
up
to
three
minutes.
If
any
member
of
the
public
testifies,
the
appellant
will
be
invited
to
provide
a
rebuttal
for
up
to
a
two
additional
minutes
board
secretary.
Could
you
please
begin
the
public
testimony
period.
B
A
Great,
if
the
Appellate
would
like
to
step
up,
if
you
could
hit
the
button
on
your
microphone,
so
the
light
turns
green
and
introduce
yourself
and
then
your
10
minutes
will
begin.
J
My
mother
and
she
is
a
retired
immigrant.
She
doesn't
speak
English.
That
is
the
reason
why
I'm
here
giving
the
story
and
the
situation
my
mom
purchased
the
property
last
year,
2021
August,
the
purpose
of
buying
that
property
is
because
for
retirement.
She
wanted
us
right
now
and
also
retiring
Palm.
Spring
me
and
my
wife
had
a
kid,
so
she
decided
to
stay
with
us
and
during
that
time.
After
closing,
she
wanted
to
make
some
rental
income
because
of
our
language
barrier.
J
So
initially
she
found
a
a
person
in
Orange
County
that
does
sorts
of
Rental
Management
and
the
person
comments
my
mom
to
rent
the
property
out
as
a
short-term
rental
vacation,
and
that
person
said
that
they
have
a
lot
of
experience
in
doing
the
stuff.
They
ran
parties
all
over.
You
know
the
the
country
getting
Palm
Springs,
though
they're
very
familiar
with
the
process
and
our
property
would
be
a
very
profitable.
J
So
my
mom
said
yes,
because
the
house
has
been
vacant
for
six
seven
months
and
she's
you
know
paying
for
for
the
installments.
She
said:
okay,
let's
do
that.
So
they
went
ahead
and
you
know
took
pictures
and
did
all
that
stuff
and
they
said
okay
I
need
you
guys
to.
You
know,
sign
some
paperwork
for
the
application
of
permits
and
all
that
stuff
which
we
did
and
after
we've
done,
that
we
send
it
in
and
we've
got
rejected
the
first
time
because
it
said
that
it
had
some
missing
documents.
J
So
we
went
back
and
we
said
what
it
was.
They
said
they
need
some
cool
inspection,
so
we
went
ahead
and
did
that
and
paid
for
it
and
sent
document
back
and
then
this
is
the
time
where
we
found
out
that
we
had
a
citation.
So
we
so
we
we
said
you
know
we
were
asking.
We
said:
why
is
there
such
a
citation?
You
know
so
they
said.
Well,
you
know
we
needed
the
permits
and
then
the
listing
is
up.
J
So
that's
the
time
when
we
say
because
my
mom
first
of
all,
she
doesn't
know
the
process
and
she
so
she's
asking
these
questions.
You
know
we
need
the
purpose
we
apply
for
the
permits,
but
they
said
well,
you
know
you
you.
We
have
to
have
the
permanence
and
as
well,
so
all
of
a
sudden
it
becomes
our
problem
when
we
asked
the
managed
company
we
said
so.
What
exactly
is
the
process?
They
said
it.
This
is
their
work.
J
They
said
that
you
know
you
can't
run
the
property
and
you
can
open
it
up
and
get
some
momentum
and
get
some.
You
know
family
and
friends
reviews
so
and
while
we
apply
for
as
a
patients,
we've
done
this
all
the
time.
You
know
across
our
properties-
and
you
know
that's
kind
of
what
they
explained
to
us
and
said
it's
okay,
so
my
mom
do
have
a
contract
with
them,
so
the
property
technically
still
under
you,
know
their
management.
So
the
situation
is
that
we
are
paying
the
fines.
J
But
again
you
know
she's
she's,
not
the
one.
That's
running
the
property,
and
so
here
we
are
discussing
and
this
the
situation.
This
situation.
A
You
so
and
there's
nobody
else
that
wish
to
speak.
Okay,
so
we'll
close
the
public
portion
the
next
well
opportunity
for
board
members
to
ask
you
questions.
Why
don't
we
start
with
question
Chair
King.
K
So
we
heard
that
is
that,
do
you
know,
are
you
acknowledging
that
it's
still
being.
J
Right
I
do
know
because
before
I
came
here,
I
I
do
know
because
before
I
came
here,
I
wanted
them
to
come
with
me.
The
management
company
they
they
all
refused.
Of
course,
so
and
I
said
it's,
it's
still
renting
I
said
yes,
I
have
a
contract
with
you
guys,
it's
technically
my
property,
so.
D
J
It's
not
your
property,
because
you
know
it's
our
property.
We
said
you
could
rent
it,
but
not
knowing
what
the
process
looks
like.
If
we
knew
that
this
is
going
to
happen,
we
get
defined
and
and
we're
going
to
be
permanently
banned
and
all
that
stuff.
Of
course
we
would.
We
would
have
never
done
that.
You
know
you
didn't
tell
us
that
so
that's
kind
of
a
situation,
yeah.
J
Their
office
is
in
Orange
County.
They
have
a
small
office
from
the
Orange.
J
We
live
two
and
a
half
hours
away.
We
I
live
in
Yorba
Linda,
my
mom
lives
in
Chino
Hills
and,
like
I
said
she
only
speaks
Chinese,
so
her
community
is
very
small.
She
she's
you
know
and
she's
also
an
immigrant,
so
she
doesn't
have
a
lot
of
people
that
she
knows
so
when
she's
stuck
with,
probably
for
six
times
a
month,
she's
looking
everywhere,
so
that.
J
To
be
honest
with
you
this,
this
is
I
mean
this
is
her
first
investment
property
very
retirement.
She
she
has
zero
clue.
I
mean
this
is
even
a
news
to
me
that
this
is
what
you
need
to
do
and
it's
how
strict
it.
D
J
We
do
we
receive
a
percentage
of
it,
they
take
35
off
the
rental
income
and
then
we
receive
the
the
balance
of
the
the
rent.
A
Actually,
and
who
set
up
the
Airbnb,
but
they
did,
they
did
yeah
okay,
so
you
said
you
just
checked
the
acknowledged
that
the
ad
is
still
up,
I'm,
really
curious
as
to
why
the
ad
is
still
up.
J
We
don't
have
that
Airbnb
accounts,
we
don't
have
access
to
the
ad
itself
and
the
payment
goes
to
their
bank
and
then
we
get
a
check
from
the
afterwards
once
they
deduct
their
fees.
So
technically
they're
I
mean
we
could
go
and
lock
up
the
house
and
do
all
that
I
mean
we
I
mean
that's
probably
the
the
only
way
for
us
to
do
so,
but
they
have
access
to
everything,
and
so
that's
why
I
want
to
kind
of
know
what
our
options?
What
should
we
do
in
this
case?
In
fact,
yeah.
D
What
you're
asking
but.
A
I'm,
just
very
surprised
that
it's
been
eight
months
and
it's
still
you
know-
we've
seen
the
letters
the
city
sends
out
they're.
You
know
pretty
intimidating
and
eight
months
later,
if
nothing
has
changed.
That's
kind
of
surprising
to
me.
J
Well,
the
situation
is
this:
the
only
reason
why
I'm
enrolled
in
this
situation
is
because
my
mom
is
really
getting
very
desperate
with
the
situation
she's,
paying
monthly
mortgage
of
very
large
amount
and
her
payment
that
she's
receiving
does
not
cover
and
she's
getting
these
huge
citations.
So
from
our
perspective,
we
want
we
want
the
house
back,
we
would
rather
lease
it
out
long
term
and
whatever
the
case
might
be
so
that
she
could
just
cover
her
expenses,
so
she
called
me
up.
She
says:
we've
got
the
citation.
J
Can
what
can
we
do?
I
say:
well,
you
can
appeal
and
at
least
bring
the
story
forward.
Let
everybody
know
what
he's
going
on
and
then
we
can
go
from
there
because,
as
far
as
I
know,
I
don't
have
any
answers
for
her.
So
the
management
company
has
all
the
keys.
They
have
all
different
cameras.
They
have
basically
the
the
the
the.
What
do
you
call
it,
the
the
law
codes
on
the
in
front,
and
so
so
that's
the
situation,
my
mom,
she
don't
speak
like
she
didn't
drive
it.
J
A
From
the
board
to
the
Apollo
yeah,
okay,
so
we
will
close.
Do
you
have
anything
else
you
want
to
do?
Okay,
so
we'll
close
the
public
testimony
portion
in
the
next
time
will
be
the
board
to
discuss
what
we've
heard
from
both
sides.
D
This
is
the
most
egregious
case.
We've
had
since
I've
been
on
the
board
for
the
last
few
years,
and
there
are
things
they
can
do:
change
the
lock
do
whatever
you
need
to
do,
but
this
I
don't
know
when
we
can
talk
about
it
later,
whether
the
city
council
changed
so
we
can
go
after
that.
Somebody
could
go
after
the
management
company,
but
this
is
a
case
where,
if
I
were
whatever
I
go
after
the
name,
but
this
is
pretty,
this
is
pretty
appalling.
C
A
Hedrick
any
discussion
points
not
at
this
time.
Thank
you,
okay,
so
I
think
you
know
my
feeling
is
kind
of
in
line
with
what
we're
describing
other
other
board
members
are
describing
I
mean
this
is
unfortunate,
that
they
were
given
terrible
advice
by
a
management
company
that
either
didn't
know
or
didn't
care
about
the
rules,
but
as
the
owners,
as
we've
discussed,
they're
still
accountable,
and
the
fact
that
the
ad
is
still
up
to
me
is
pretty
egregious
and,
as
you
were
describing,
you
know
really
escalates
this.
A
It's
been
eight
months
a
little
bit
more
than
eight
months
and
they
are
putting
the
owners
at
risk
of
a
second
fine,
which
is
twice
the
amount
of
the
first
fund,
and
the
third
sign
is
two
and
a
half
times
the
second
time
so
I
mean
these
are
very,
very
serious,
but
you
know
I
guess
the
bottom
line
is
they're,
getting
terrible
advice,
but
I'm
not
seeing
that
there's
been
a
real
effort
to
to
take
this
property
back
under
control
and
stop
letting
somebody
break
the
law.
A
So
that's
my
comments.
Anything
else
from
the
board.
C
B
A
So
what
happened?
Is
we
upheld
the
fine
and
the
ban?
The
city
will
contact
you
in
an
official
capacity.
I
think
you've
heard
from
a
variety
of
board
members.
You've
got
terrible
advice
from
that
management
company
and
they
did
you
a
huge
disservice.
K
A
C
A
C
A
A
If
they're
not
taking
the
ad
down
for
you,
you
should
be
calling
Airbnb
and
tell
them.
That's
your
property
they're
not
authorized.
E
J
A
A
A
A
I've,
always
you
know
from
my
my
real
estate
background
I'm,
always
very
careful
like
people
always
ask
me
real
estate
and
tax
advice.
I'm
like
I
am
not
qualified
all
right.
So
we're
going
to
move
on
to
case
number
five
or
item
number
five
in
the
agenda.
This
concerns
the
property
at
1585,
East,
Madrona
Road
in
Palm
Springs.
A
It
is
the
appeal
of
a
2500
fine
and
an
administrative
decision
that
Wesley
I
apologize.
If
I
say
this
wrong,
Jose's
all
right,
that's
close,
but
not.
Okay!
All
right!
Thank
you!
We'll
have
a
six-month
vacation
rental
certificate
suspension
board
secretary.
Could
you
please
ensure
that
City
staff
in
the
accountant
understand
their
testimonies
on
the
road.
F
The
department
of
special

provides
determine
this
violation
after
comparing
contract

to
remitted

that
was
collected
by
our
finance
department
for
the
months
of
July
and
August
2022,
showing
that
there
were
trans
democracy
texts
received
for
those
months
and
there
was
no
contract
summary
so
submitted
for
those
respective
short-term
stays.
Staff
issued
a
code
of
compliance
officer
issued
ab0415
for
failing
to
submit
contract
summaries.
F
F
Board
fellow
City

of
public

on
the

tonight,
my
name
is
supervisor
with
the

Palm

currently
overseeing
the
vacation
program,
prepare

we
read
off
of
it
on
Wednesday
October,
26,
2022,.
F
Occupancy
taxes,
dot
and
submitted

data
is
found
property
located
at
1585
and
Jones
Drive,
that
recorded
tot
submissions
for
July,
2022
and
August
2022,
but
did
not
submitted
in
the
contract.
Soil
resides
required
for
any
vacation
rental
stays
during
that
same
period,
I
contacted
the
property
on
Western
on
Thursday
October,
27th
2022,
via
phone
to
discuss
my
findings
during
a
film
discussion.
Once
you
confirmed,
the
property
has
been
operating
his
vacation
rentals
since
July
of
this
of
this
year,
which
was
shortly
after
the
vacation,
rental
registration.
F
A
request
that
he
provide
me
with
copies
of
all
the
contracts
that
they
have
entered
into
with
persons
who
have
booked
the
property
for
short-term
States,
since
the
start
of
when
they
began
operating
as
a
registered
vacation
rental,
which
was
determined
to
be
July
of
2020
I
established
timeline
method
of
delivery
to
receive
a
requested
information.
Lastly,
later
that
afternoon,
the
information
was
sent
to
via
email,
as
requested
upon
review
of
the
documents
is
found.
F
A
couple
things
worth
noting
1585
and
Governor
Drive
was
issued
their
vacation
rental
registration
on
June,
15
2022
with
Wesley
City,
that's
collected
and
started
advertising
the
property
for
short-term
States
in
July
2022.
prior
to
this
Western
vacation
rental
certificate
for
a
different
property
in
the
city
from
February
2020
to
February
2022.
So
this
was
the
second
property
that
he
called
registration
certificate
for
foreign.
E
A
Thank
you.
Thank
you
all
right,
so
we'll
open
it
up
to
questions
from
the
board
to
the
city.
Why
don't
we
start
with
Mr
Hedrick,
all
right,
I
think
he
announced
no
questions.
E
No
questions,
Mr
Moses,
no
questions
about.
K
F
F
Was
a
citation
issue
for
not
having
a
city
ID
in.
F
I
can't
check
that
those
appeals
go
through
our
third
party
contractor
Data
Ticket
they're,
the
ones
I
can
share.
A
All
right,
Patrick
I,
have
a
question
for
you
as
well
you're
looking
up
one.
Is
it
I'm,
not
sure
if
I've
heard
this
in
the
past
are
there
when
you
find
that
somebody's
not
submitting
the
contracts?
Is
there
any?
Was
there
Outreach,
like
you,
had
a
conversation
with
them?
A
Is
there
a
chance
to
rectify
that,
or
is
it
just
is
what
it
is.
So
in
the
past.
F
It
hasn't
been
a
practice
to
the
city
to
take
enforcement
action
on
these
particular
issues.
It
was
something
that
recently
came
forward
due
to
some
additional
staff.
Now
we
got
a
bandwidth
to
do
it
and
it
also
came
about
as
a
result
of
the
working
group
and
the
ordinance
Provisions
That
was
supposed
to
review,
take
place
on
the
submitted
contract
summaries,
so
it
with
any
violation
of
vocational
ordinance
there.
F
It
specifically
states
that
there's
no
courtesy
or
presentation
notice,
given
so
in
this
case,
you
know
we
we
haven't
done
Outreach
to
do
that
in
the
past.
As
far
as,
if
we've
gotten
complaints
for
active
disturbances
and
we've
gone
out,
and
we
discovered
that
it
was
rented,
we
have
provided
education
classified
education
to
inform
the
owners,
but
that
really
ended
in
July
of
2021
and
that's
when
we
really
started
pursuing
citations
for
the
fed
the
contract
summaries.
F
K
F
There's
something
there's
a
couple
of
video
webinars
on
how
to
submit
a
contract
summary.
So
you
know,
taking
all
that
into
account.
You
know
at
this
point
is
taking
is
that
if
we
are
coming
across
this,
we
are
trying
to
be
more
proactive
in
finding.
You
know
defense
of
not
so
many
contracts
on
routines
to
to
hold
them
accountable
and
and
take
a
take
action
as
far
as
issues
and
citation
instead
of
trying
to
gain
compliance
by
continued
education,
okay
and.
E
A
C
A
Know
yeah
because
you
said
that
that
the
appellant
had
a
previous
permit
was
was
that
at
a
time
where
contract
summaries
were
required
and
those
were
turned.
F
In
correct
so
the
for
the
previous
property
that
we're
going
to
search
earlier
this
afternoon
and
our
rep
is
to
go
back
pretty
far
to
adopted
some
new
ordinance
and
I
did
not
see
any
submitted
contract
summaries
for
that
particular
property.
So
you
know
I
wasn't
able
to
see
if
there
had
been
any
Outreach.
I
know
that
Patrick
over
you
know,
over
the
year
2021
had
been
going
quarterly
and
trying
to
send
out
notifications
for
folks
who
weren't
submitting
anything
I
I'm,
not
able
to
tell
you
if
that
particular
property.
F
A
Is
it
safe
to
assume
that
as
part
of
the
application
process
there
was
that
form
with
the
checklist
and
I
believe
that
checklist
has
something
on
it
where
they
have
to
initial
that
contract
summaries
are
required.
So
is
it
safe
to
assume
that
that
would
have
been
part
of
their
application,
correct.
F
Based
off
the
timeline
of
when
the
application
was
submitted,
it
would
have
been
after
we
had
started
issuing
citations
for
no
contract
summary.
So
our
os
office,
special
programs,
admin
staff
had
been
making
it
a
point
to
ensure
that
they
are
communicating
that
out
to
to
folks
who
are
sending
their
applications
about
making
sure
that
they're
sending
their
contracts.
E
F
Yes,
so
do
you
see
that
the
citation
was
paid
but
no
appeal
receipt?
It
was
paid
in
August,
1st
violation
unless
for
Noid
I,
don't
know
see
like
I
should
say,
but
looking
at
the
attached
documents,
there's
no
appeal
in
that
system.
However,
if
it
was
submitted
and
for
some
reason
we
see
that
the
vendor
did
not
process
it
correctly.
We
do
have
discretion
to
approve
such
appeal.
F
You
know
I
would
ask
that
because
they
use
they
like
to
have
that
mailed
to
them,
so
it
could
have
been
mailed
and
never
got
to
our
vendor.
So
if
we're
seeing
difficulties
with
mailing
and
getting
to
our
vendor,
you
know
we
would
be
happy
to
take
that
appeal
and
email
it
to
them
personally
and
then
make
sure
that
appeal
is
going
for
it.
So.
K
F
Yeah,
we
usually
do
get
kind
of
like
a
what
we
call
just
Grace.
C
F
A
wind
down
period,
so
there's
no
near-term,
guess
affected
from
the
city's
action,
but
yeah
December
12th.
A
To
June
12th
2023
suspension.
A
Okay,
thank
you.
I
have
no
further
questions
any
more
questions
from
the
city
for
this
city:
okay,
okay,
so
this
time,
we'll
open
the
public,
the
public
part
of
the
hearing,
the
appellant
will
be
invited
to
speak
for
up
to
10
minutes.
Any
member
of
the
public
who
desires
to
speak
on
this
appeal
hearing
shall
have
up
to
three
minutes
to
speak,
and
if
any
member
of
the
public
testifies,
the
appellant
will
be
invited
to
provide
a
rebuttal
for
up
to
two
additional
minutes
board
secretary.
Can
you
please
begin
the
public
testimony
period.
B
L
You
thank
you
for
allowing
me
to
speak
on
this
issue.
I
went
to
Great
Lance
to
be
here
today,
just
all
of
the
travel
issues.
I
had
two
canceled
flights,
I
left
family
time
with
with
I
left
family
time
early
in
order
to
be
here
today
and
I
actually
had
to
drive
over
12
hours.
L
In
order
to
be
here
and
I
say
all
that
to
say
that
I
take
you
know
this
requirement
and
being
here
and
having
this
discussion
with
you
guys
very
seriously
understand
that
we
take
our
responsibilities
and
and
the
rules
that
are
set
before
us
for
the
vacation
rental
very
seriously.
We've
been
in
Palm
Springs
for
four
years
and
we
love
it.
L
Our
neighbors
know
us-
and
we
do
business
here,
but
more
importantly,
we're
in
grading
into
the
community
here,
and
it
was
our
idea
to
buy
homes
down
here
to
that
we
may
one
day
retire
here
this
year
alone,
I've
spent
over
127
days
in
Palm,
Springs,
back
and
forth
from
Northern
California.
L
This
has
truly
been
a
second
home
to
me,
Palm
Springs
has
and
throughout
the
I
we
thought
of
doing
vacation
rental
as
a
means
of
supplementing
some
of
that
income
and
being
able
to
carry
the
second
home,
but
also
so
that
it
doesn't
sit
vacant
in
the
area
we're
in.
We
have
a
lot
of
porch,
Pirates
and
and
things
of
that
nature,
so
so
that
the
house
doesn't
sit
empty
in
between
our
stays.
We
decided-
let's
short-term
rent
it,
but
you
know
the
this
year.
Short-Term
rentals
have
been
little.
L
L
I
made
a
mistake:
I
didn't
submit
all
of
the
staff
all
of
the
steps
we
paid
our
taxes
on
time,
I
communicated
all
the
rules
to
the
tenants
and
everything
as
they're
expected
I
collected
all
the
documentation
from
them.
That
I
should
have
I
just
missed,
sending
those
contracts
some
ways,
and
it
was
a
costly
error
error.
L
It
won't
happen
again.
I
was
in
the
process
of
of
lining
up
and
securing
Professional
Management
prior
to
receiving
the
call
in
regards
to
this.
So
it's
my
partner
and
I.
We
she
handles
the
front
end.
I
handle
the
back
end
the
taxes
paid
and
me
doing
all
the
paperwork
it
something
missed.
L
It
fell
through
the
cracks
to
State
the
email
that
we
were
given
our
certificate
on
I
will
say
that
the
contract
selling
summaries
and
I
can
forward
it
to
you
is
very
pretty
far
down,
but
it's
there
so
I
won't
deny
that
it's
there.
L
The
previous,
the
previous
citation,
was
brought
up.
I'd
like
to
speak.
To
that
we
were
given
our.
We
were
granted
short-term
approval
on
615
on
June
15th.
We
received
a
citation
on
June
22,
in
which
the
house
wasn't
even
ready
for
rental
at
that
point
in
time
and
I
think
when
we
did
have
it
on,
we
had
it
for
28
days
rental
only
and
it
was
blocked.
L
We
had
the
amount
of
time
that
was
blocked
at
least
until
July
15th,
because
that
was
when
we
were
expecting
to
get
for
the
home
to
be
ready.
So
we
were,
but
we
didn't
get
our
certificate
that
by
the
rules
is
supposed
to
be
posted
in
the
house.
We
didn't
get
that
certificate
until
July
5th,
so
I
wouldn't
have
made
the
correction
to
place
the
TLT
on
there,
because
I
wasn't
ready.
I
was
still
advertising
the
25
28
days
at
that
time.
L
So
we
technically
received
a
violation
that
before
we
were
even
ready
for
rental
so
and
that's
why
I
was
like
what's
going
on
here,
it
just
seemed
a
little
bit
like
I
didn't
even
have
time
to
make
the
correction.
A
A
few
minutes
if
no
I
I
appreciate
your
time.
Thank
you
all
right.
Thank
you.
If
you're
listening
and
there
was
no
public
that
one
other
public
members
that
wanted
to
speak
so
at
this
time,
we'll
open
it
up
to
the
board
to
ask
you
questions:
why
don't
we
start
with
Mr
Hedrick.
A
So
I
do
so
who
did
the
application
to
the
city
for
the
permit?
Sheila?
Okay,
oh
he's,
throwing
you
under
the.
E
A
And
so-
and
maybe
you
can
answer
this
so
as
I
asked
the
city,
there
is
a
form
in
there
with
a
checklist
I,
don't
remember
everything.
That's
on
that
checklist,
but
you
have
to
initial.
L
I
would
like
to
say
that,
due
to
the
process,
there
is
a
lag
right,
so
there's
a
lag
between
when
we
submit
the
the
application
and
we
sign
off
on
all
these
things
to
do.
E
L
To
when
we
actually
get
our
first
book,
our
first
check-in
or
our
first
book
right,
there
had
to
be
four
or
five
months
that
between
that
time
and
during
that
time,
I
will
say
that,
navigating
through
all
of
the
steps,
there
isn't
a
clear
one,
two
one
two
three
step
to
this
process,
which
would
be
really
helpful,
especially
if
I
go
to
pay
the
taxes.
Hey.
Did
you
complete
your
contact
contract
summaries.
L
I,
know
it's
after
the
fact
at
that
point
that
you're
paying
taxes,
but
it
would
be
nice
to
have
a
clear
one,
two
three
step
to
monthly
compliance
or
or
or
something
but
I
have
to
go
to
the
first
page
in
order
to
get
to
where
the
contract
summaries
are
and
then
I
have
to
go
to
a
different
page
which
I
earmark
every
month
to
where
I
have
to
pay
the
the
taxes.
But
then
there's
there's
also
a
link
to
where
all
the
documentation
is
that
you
have
to
provide
to
each
to
each
guest.
L
So
it's
just
kind
of
all
over
the
place.
I.
Couldn't
imagine
being
you
know,
70
years
old,
trying
to
just
rent
out
a
room
in
my
home
and
dealing
with
like
I
mean
it's
a
lot
where
that's
why
I
said
all
right,
let's
get
some
Management
in
to
free
us
up
some
time.
M
A
M
Was
my
signature
and
I
did
miss
the
contract
summary
and
I?
I
may
not
have
even
understood
what
the
contract
summary
was
because
once
again,
when
we
ran
it
before
and
there
was
a
lag
so
we
had
Airbnb
than
we
didn't
for
a
while,
then
we
got
this
home.
We
were
able
to
upgrade
and
get
Bissell
and
we
started
Airbnb
again
and
there
wasn't
a
contract.
Summary
wasn't
part
of
the
process,
and
so
even
when
they
called
you
know,
we
thought
we
were
like
yeah
here.
We've
done,
our
DOT
we've
done
everything,
and
we
did.
M
We
totally
thought
we
were
in
compliance
until
we
found
out
we
weren't,
and
it
did
take
me
a
while
going
through
to
even
find
oh,
this
is
what
they
were
talking
about
and
then
I
showed
him.
It's
like
this
is
what
they
were
talking
about
and
I
have
a
brother
who
had
just
started
and
before
he
had
any
guess,
I
was
like
this
is
what
you
got
to
do,
and
so
I
even
told
him,
but
it
was
something
that
was.
M
A
Okay,
so
we'll
close
the
public
testimony
period
and
then
the
next
section
will
be
for
the
board
to
discuss.
Why
don't
we
start
from
the
other
end?
I,
don't
remember
where
I
started
last
time,
Vice
Chair.
A
A
A
You
know
as
they're
required
and
from
my
own
experience.
I
know
the
city
allows
you
to
do
it
up
until
the
check-in
day.
So
it's
not
something
that
has
to
be
done.
You
know
a
certain
time
in
advance
or
anything
like
that.
A
So
from
my
perspective
you
know
it's
it's
it's
reminded
to
the
the
permit
holders
multiple
times.
I
will
absolutely
agree.
It's
not
an
easy
process,
but
you
know
there's
loads
and
loads
of
permit
holders
that
are
able
to
to
do
it
and
do
it
accurately.
So
that's
all
I
got
to
say.
If
anybody
has
any
more
comments,
all
right
is
there
a
motion
in
a
second
please.
A
All
right
next
item
on
the
agenda
is
the
approval
of
minutes
for
November
30th
2022..
So
second.
B
A
A
There
was
discussion
it
probably
a
couple
of
years
ago
that,
as
part
of
the
that
effort
to
inform
the
public
about
the
ordinance
and
the
requirement
to
have
a
permit,
that
there
was
going
to
be
a
requirement
that,
at
a
closing
for
a
property
within
the
city
of
Palm
Springs,
that
there
would
be
some
sort
of
an
affidavit
that
they,
the
purchase
or
the
buyer,
had
to
sign.
It
said
you
know
if
you
need
a
permit
in
Palm
Springs
to
operate
a
short-term
rental.
Do
you
know
if
that
was
ever
implemented?.
F
So
I
do
recall
that
an
administrative
regulation
was
signed
off
for
that
requirement,
but
as
far
as
enforcement
practice
or
making
sure
that
that's
being
signed
again,
we
haven't
taken
that
step
yet
in
our
department.
So
if
that's
something
that
they
need
to
ask
each
applicant
for
you
know
when
they're
glad
you
had
that
sort
of.
A
Veronica,
if
you
want
to
weigh
in
on
that,
that
would
be
great.
Yes,.
I
It's
been
drafted
and
we've
been
working
with
the
Outreach
and
I
believe
that
Mr
Hoban
has
assisted
Us
in
providing
that
notification
for
the
realtor.
So
it
is
something
that
we
are
currently
implementing.
A
All
right
great,
thank
you
and
just
for
the
board.
The
reason
I
asked
that
is,
we
so
frequently
hear
people
say
you
know
they
didn't
know,
and
that
is
just
one
more
of
those
ways
they
probably
do
know
and
as
we've
talked
about
before
Airbnb
and
VRBO,
both
when
you
set
up
a
property
in
Palm
Springs,
they
have
a
box
a
pop-up
window.
That
says
you
know
there
are
rules
in
your
municipality
that
require
a
permit
and
you
have
to
check
or
something
that
you
understand
that.
A
Up
just
because
again,
I
want
us
to
all
understand
that
that
it
is
very
difficult
for
somebody
not
to
know
that
we
require
a
permit.
Anybody
else
on
the
board
have
anything.
G
G
I
watched
the
meeting
for
actually
I
was
going
to
attend
for
two
reasons:
one
because
I
thought
there
was
going
to
be
some
airport
things
on
there,
but
the
second
I
was
interested
were
the
restrictions
are
going,
but
there's
started
to
be
a
discussion
about
us
and
one
city
council
member
who
is
leaving
the
city
council
said
that
our
board
does
goes
easy
on
our
neighbors
and
does
not
uphold
fines.
All
the
time
which
I
found
surprising.
G
So
I
contacted
mayor,
Middleton
and
told
her
that
you
know
of
the
almost
300
cases
that
I'd
been
involved
with
I.
Think
we've
only
had
one
or
two
where
we
didn't
uphold
the
fine
and
that
we
were
very
strict
in
following
the
code
to
the
max.
G
One
of
the
things
they
talked
about
doing
is
is
to
have
a
review
process
of
our
decisions
that
everyone
that
is
going
that
has
been
fined
or
loses.
Their
case
can
appeal
to
city
council,
and
if
they
get
two
members
of
the
city
council
to
agree,
then
the
case
will
but
be
brought
before
City
Council
I
also
brought
to
Mayor
Middleton's
attention.
G
Well,
both
of
the
cases
that
we
had
tonight
of
where
a
person
had
no
idea
that
their
home
was
being
rented
and
I
was
referencing.
The
LA
gentleman
we
had
that
case
again
tonight
and
I
also
referenced
the
fact
of
where
a
person
who's
hired
a
vacation
management
company
to
manage
their
property
and
to
do
it
correctly
and
you
know,
got
screwed
mayor.
Melton's
response
was
well
the
first
case.
G
That's
interesting,
you
know,
but
you
know
if
they're
going
to
be
notified
that
can
come
before
City
Council.
The
second
case
is
well.
G
She
didn't
express
any
interest
in
having
any
additional
city
regulations
for
management
companies
but
says
well.
The
management
company
can
be
sued
by
the
homeowner,
so
I
just
wanted
to
bring
that
to
the
board's
attention.
Again.
These
are
my
perceptions
of
what
happens.
Meeting
I
would
suggest
that
people
I'll
go
watch
the
tape
It's.
The
final
half
hour
of
the
meeting.
G
F
Note
that
you're
required
as
a
board
to
make
decisions
on
any
given
case
with
respect
to
the
testimony
received
at
the
hearing.
Only
and
novel
with
respect
to
outside
discussions
and
opinions.
A
K
But
just
to
Patrick
in
terms
of
what
we
heard
in
the
contract
summary
issue,
as
it
continues
to
sort
of
you
know,
be
a
learning
process,
even
though
it's
been
a
while
and
I
know,
you've
gotten
frustrated,
because
people
just
don't
do
what
you're
telling
to
do
over
and
over
by
the
way
it
would
be.
It
would
be
great
if
there
wasn't
a
situation
ever
where
there
was
a
fact
check
and
I.
Think
you've
heard
from
the
born
in
some
capacity
that,
if,
regardless
of
what.
C
K
Voted
on,
if
we
were
also
that
to
acknowledge
that
there
was
in
every
case
since,
like
not
just
by
complaint
first
time,
do
you
notice
it
if
you're
doing
reviews
there's
some
sort
of
you
know,
I,
don't
know
what
you
call
it.
It's
courtesy
notice.
K
To
gain
compliance,
because
I
think
this
is
I've
said
this
before
right.
We're
here
I
would
hope
in
general
to
get
compliance
not
to
do
gotcha
government
and,
like
you
know,
just
do
hardcore
enforcement
if
I
get
people
to
do
the
right
thing.
So
it's
just
a
comment.
Obviously
you
guys
having
some
experience
and
writing
compliance
and
enforcement
myself.
It's
it's!
It's
a
it's
a
thought
rather
to
how
you
continue
to
roll
out
of
you
know:
enforcement
around
contact.
Somebody!
That's
all.
E
C
A
And
I
think,
as
Patrick
I
think
described,.
A
F
Yeah,
that's
true.
We
do
have
an
admin
right
too,
that
states
that
we
can
issue
citations
usually
upon
violations.
However,
you.
A
F
When
I
took
this
position
from
19,
we
did
know
that
there
was
a
lot
of
Education.
We
did
do
as
officer
now
imagine
we
did
a
good
few
years
of
identifying
properties
that
weren't
being
contract
centers,
that
primary
fall
during
the
analysis
and
finding
over
100
properties
yeah.
But
if
we
did
do
that
and
that's
it,
you
have
to
make
the
decision
to
say
anything.
K
And
it's
just
a
decided
I've
just
my
two
times,
not
that
you're
right
or
wrong
or
anyone's
doing
this
properly
or
not
properly.
Just
if
someone
comes
into
this
game
new
by
the
house
didn't
get
the
benefit
of
all
that
Outreach
right
now.
It's
just
like
really
really
cut
and
dry
granted.
They're
