and
reconfigure
some
of
the
existing
Fitness

facilities,
while
taking
advantage
of
the
infrastructure
proposed
to
remain.

H
B
You
any
any
other
questions,
no
questions,
I
have
one
question:
I
was
there
today
and
it
appeared
like
there
was
already
work
being
done
inside
and
you
could
see
a
lot
of
activity
on
the
outside.
One
of
the
big
double
doors
had
fresh
framing
on
it.
Is
that
typical
that
work
gets
started
before
this
body
gets
a
chance
to
weigh
in
on
it.
B
You
any
other
questions.
Okay,
and
now
we
come
to
our
public
speakers
and
the
first
one
is
our
applicant.
J
Hello,
my
name
is
Amy
Simons
and
I'm.
A
resident
of
Westlake
Village
I
am
also
the
Chief
Operating
Officer
of
momentum
agencies.
We
have
a
long
history
of
providing
Innovation
and
programs
and
services
for
children
and
adults
with
developmental
disabilities.
We
started
in
1945
as
United
Cerebral
Palsy
of
Los
Angeles.
We
have
been
in
Thousand
Oaks
since
1988
when
we
established
two
group
homes
and
we're
happy
to
that.
30
individuals
are
able
to
call
Thousand
Oaks
their
home.
J
We
provide
pediatric
programs,
we
have
over
30
program
sites
across
five
counties
and
we're
very
excited
about
this
specific
project.
We've
looked
all
over
for
a
building
that
could
accommodate
our
day
programs
and
our
expansion.
We
are
currently
supporting
40
adults
in
day
programs
in
the
area,
and
this
is
going
to
allow
us
to
expand
to
over
a
hundred
and
allow
for
supportive
employment,
allow
for
Pediatric
programming
and
allow
for
art,
programming
and
interaction
and
inclusivity
in
the
community
by
also
having
opportunities
for
the
community
to
interact
and
engage
in
the
space.
J
Also,
so
we're
really
excited
about
that.
It
does
go
back
to
our
mission
that
you
previously
heard
were
really
dedicated
to
the
full
citizenship
of
everybody
that
they're
able
to
reach
their
goals
of
Independence,
and
what
that
means.
This
location,
in
particular,
is
going
to
be
able
to
be
a
resource
to
families,
individuals
through
their
lifespan,
going
through
the
system
with
developmental
disabilities.
J
We
were
very
fortunate
that
the
architectural
firm
Gensler
had
had
identified
us
as
a
community
impact
project.
They've
been
with
us
trying
to
go
through
this
for
several
years
and
find
the
right
building,
and
so
we
are
excited
that
there
was
the
infrastructure
that
was
already
there.
It
didn't
require
us
going
from
the
ground
up,
and
so
it
allows
us
to
be
able
to
get
in
there
and
start
programming
as
soon
as
possible,
which
is
what
we're
trying
to
do
right
now.
J
That's
why
you
see
so
much
activity
we're
just
really
trying
to
make
the
space
once
we
had
this,
that
we'd
be
ready
to
go.
So
that's
what
we
were
investing
some
of
our
time
and
our
energy
and
our
funds
for
a
couple
of
the
areas
that
we
have
available
and
I
had
a
presentation
that
I'm
not
forwarding
through
here.
J
So
we
do
have
things
like
momentum,
creative.
There
you
go.
So
we
have
our
pediatric
programs
we'll
just
go
on
through
so
as
far
as
providing
Physical
Therapy
occupational
therapy
and
speech
therapy
programs
and
then
we'll
also
have
strengthening
and
fitness
health
and
well-being,
programming
for
adults.
E
Thank
you
chair
just
a
few.
Thank
you
assignments
for
going
through
the
process.
I
I
in
looking
at
this
process.
I
know
you
said.
Historically,
you
were
dealing
with
cerebral
palsy
and
some
other
things,
but
this
is
open
to
anybody
in.
J
Thank
you
for
bringing
that
up,
so
we
actually
changed
our
name
in
2021,
and
that
was
because
we've
always
supported
more
than
just
people
with
cerebral
palsy,
and
we
also
wanted
to
get
away
from
a
diagnosis
in
our
name,
because
we
wanted
to
be
able
to
be
a
resource
that
was
empowering
more
than
anything,
and
so
that
was
the
brand
change
and
then,
in
addition,
we
also
that's
part
of
the
inclusive.
We
want
to
be
able
to
provide
supports
for
everybody.
J
We
actually
had
a
group
reach
out
to
us
that
has
fitness
programs
for
people
with
Parkinson's,
which
is
great.
We
want
to
have
those
kind
of
opportunities
that
we
can
have
the
interactions
and
even
with
people
who
just
want
to
support
and
interact
with
people
and
share
their
skills
and
ability.
That's
what
this
is
about,
so
whether
you're
an
artist
or
a
trainer.
This
should
be
a
location
where
we
can
all
collaborate
and
share.
E
J
Think
it's
going
to
be
definitely
throughout
the
Tri-County
area
and
then
we
definitely
know
that
there
will
be
people,
because
there
is
nothing
like
this.
So
we
do
know
that
there
are
going
to
be
a
lot
of
people
who
are
going
to
want
to
see
this
and
we're
basically
trying
to
create
this
as
a
model
that
will
be
able
to
be
replicated.
So
we
do
see
that
Thousand
Oaks
is
going
to
be
the
place
where
we
start,
and
this
is
going
to
be
pretty
significant
because
there's
nothing
like
this
I.
E
I
hope
that's
possible.
I
mean
obviously
you're
walking
into
a
situation
where
the
property
is
is
kind
of
somewhat
set
up
for
it.
So
I
don't
know
if
that
unique
opportunity
would
exist
other
places,
but
it's
it's
an
interesting
concept.
I'm
going
to
ask
the
obligatory
question:
there
was
nothing
in
our
materials
as
to
any
comments
from
any
of
the
local
neighbors.
Did
you
receive
any
Communications
from
Property
Owners
neighbors
anybody
about
the
project?
How.
J
Can
they
help
we
have
pts
is
trying
to
they
want
to
have
their
artists
display
at
their
their
showroom
and,
as
I
said,
we've
had
other
organizations.
The
yarrow
Center
wants
to
do
something
with
us,
so
we've
only
had
really
positive
things
of
how
to
get
involved.
How
can
we
do
it
and
so
I'm
happy
to
say
that
it's
only
been
positive
and.
E
And
I
know
you're
excited
to
get
started
and
may
have
already
started
to
some
some
extent
again
rough
estimate
not
holding
you
to
it.
But
when
do
you
think
this
will
be
open
and
operational
so.
J
E
J
B
Kind
of
been
okay-
let's
see
it's
a
time
for
you
to
rebut
if
you
have
a
rebuttal,
but
it
sounds
like
I'm
gonna
assume
that
you
don't
at
this
point
we
can
close
the
public
hearing
and
I
will
open
up
the
floor
for
discussion
and
or
emotion.
E
Thank
you,
chair,
I,
think
I've,
always
kind
of
said
that
the
goal
for
a
lot
of
the
different
areas
in
our
city
is
strategic,
repurposing
and
I
have
to
say,
I
can't
think
of
a
better
repurposing
concept
here
than
taking
what
was
spectrum
and
converting
into
something
that
actually
is
going
to
help.
So
many
people
that
are
looking
for
for
help
in
our
community
so
I
think
it's
a
great
concept.
E
I
could
belabor
this
for
a
long
time,
but
I'm
not
going
to
instead
I'm
just
going
to
go
ahead
and
make
the
motion
that
we
approve
initially
finding
that
the
project
qualifies
for
a
categorical
exemption
from
sequa
and
approving
special
use.
Permit
minor
modification,
sup,
Dash
2023-7008,
based
on
the
findings
and
subject
the
conditions
described
in
attachment
for.
B
C
B
C
Hearing
having
been
advertised
is
required
by
law.
Is
your
boy
open
to
consider
agenda
item
7B
protected
tree?
Permit
PTP
2023-70030
to
allow
the
removal
of
one
Coast
Live
Oak
Tree
approximately
30
inches
in
diameter,
causing
structural
damage
to
an
existing
patio
balcony
at
an
existing
multi-family
residence
in
the
RPD
Zone,
and
find
that
the
project
qualifies
for
categorical
exemption
under
the
California
Environmental
Quality
act,
Secret
guidelines
pursuant
to
section
15304
minor
alterations
to
land
located
at
3371
Holly
Grove
Street,
the
applicant
is
Tim
sokolowski.
K
K
K
K
K
K
If
left,
as
is
damage
to
the
structure,
will
likely
be
substantial
and
the
tree
will
become
weak
in
that
section
and
will
result
in
failure.
The
city's
oak
tree
consultant.
Excuse
me.
The
city's
oak
tree
preservation
and
production
guidelines
requires
a
replacement,
15
gallon
tree
to
be
planted,
and
the
city's
oak
tree
consultant
recommends
a
15
gallon
Holly
Oak.
B
So
I'd
like
to
let
my
fellow
Commissioners
know
that
John
Burke,
who
is
our
City's
treason,
is
available
to
answer
questions
via
Zoom.
So
you
can
ask
this
gentleman
here
or
John.
Burke
do
I.
Have
any
questions,
commissioner
link.
G
Thank
you
very
much
for
the
presentation.
Mr
Gomez
is
the
tree
in
its
current
state,
in
any
risk
of
falling
or
either
on
the
building
or
into
the
street.
K
It
does
have
quite
a
lien
toward
the
building
I.
Don't
think
it
is
at
immediate
risk
of
falling
at
this
time,
but
being
that
it
is
already
up
against
the
structure.
And
again
it
is
said
by
the
arborist
that,
if
it
is
left,
as
is
that
section
of
the
tree
will
become
weak
and
eventually
will
result
in
failure.
G
K
There
was
a
there
was
a
modification
to
the
original
oak
tree
permit,
filed
shortly
after
the
original
oak
tree
permit
was
filed
and
in
the
plans
for
that
subsequent
application
that
the
arborist
stated
that
there
was
already
a
lien
to
this
tree.
K
The
original
requests
were
simply
just
for
encroachment
and
minor
pruning,
but
again
I
think
there.
It
has
been
said
that
there
was
already
a
lien
to
this
tree
and
I
I,
believe
that
was
in
around
1993
when
that
application
was
applied
for
okay.
G
K
It's
been
stated
by
our
arborist,
who
went
out
to
the
property
that
there
is
already
a
displacement
of
the
structure,
so
I
I'm,
assuming
that
removal
of
the
tree,
which
is
what
they're
seeking
approval
for,
should
happen,
and
then
they
should
assess
what
kind
of
damage
and
what
kind
of
repair
construction
should
take
place
and
obviously
pull
all
the
proper
building
permits
for
that.
Okay,.
G
And
one
final
final
question:
before
I
take
up
too
much
time:
I
had
a
chance
to
look
at
the
the
inner
which
the
internet
never
forgets
and
had
a
chance
to
look
at
Google,
Earth
or
Google
Street
View,
and
it
appears
that
this
tree
was
already
leaning
on
the
deck
as
of
2011.,
why?
Why
was
there
no
permit
or
application
for
a
tree
permit
12
years
ago,
when
this
was
a
problem.
K
I'll
leave
that
up
to
the
applicant
to
answer
he
was
the
art,
he's
the
arborist,
that
that
represents
the
applicant,
the
property
owner,
and
he
can
probably
give
you
some
background.
I
will
ask
you.
Thank
you.
L
L
It
was
brought
to
my
attention
by
the
property
manager,
because
this
particular
homeowner
is
now
being
significant
damage
to
their
patio.
So
maybe
at
that
time
it
wasn't
a
huge
concern
because
the
damage
was
minimal,
but
I
can't
speak
I'm.
Just
you
know,
I
was
right
out
there
to
accept
it
today
and
not
back
in
2011..
So
again,
I
can't
I
can't
speak
to
why
it
was
never
brought
up
before.
I
Right
so
we're
not
there
yet
right
right:
okay,
I
just
want
to
be
okay,
because
we
were
my
understanding
is
there's
also
a
city
consultant
on
the
line.
Yes,
is
that
correct?
Okay,
I
think
that
was
my
assumption
going
it
I
just
wanted
to
be
clear.
Okay,
thank
you.
Let
me
ask
first
I
noted
in
the
conditions
for
approval
that
the
tree
mitigation
is
for
a
15,
gallon
Holly
Oak
per
the
recommendations
of
the
city's
oak
tree
consultant
memo
dated
February
18
2023..
I
Perfect
in
that
memo,
it's
it.
It's
talks
about
approving
the
permit
to
remove
one
here,
a
joke
causing
substantial
property
damage,
replace
it
with
a
specimen
having
a
strong
central
leader
that
can
be
pruned
to
fit.
The
tight
space
is
the
recommendation
that
the
15
gallon
Holly
yoke
will
be
placed
on
site
in
the
room,
the
the
space
where
we're
moving
the
tree
or
is
it
being
done
offside,
I've,
just
I
I?
It
was
unclear
to
me
kind
of
like
what
the
recommendation
was
if
it
was
going
to
be
placed
back
on
site.
K
The
requirements
only
to
plant
the
replacement
oak
on
the
property
they
can
choose
to
plant
it
in
its
place.
An
aerial
view
of
that
property
shows
that
there
are
a
lot
of
trees
with
not
many
places
to
plant
a
replacement
tree.
K
I
K
The
that's
the
requirement
I
think
the
hollyoak
was
chosen
to
be
placed
in
that
particular
space.
Maybe
because
there
are
again
and.
I
Also
because
the
the
tree
report
appears
to
me
that
it
was
generated
by
the
applicant
is
that
is
that
correct,
or
the
representative
of
the
applicant.
B
Not
okay,
so
the
applicant
will
have
a
chance
to
talk
right
now.
This
is
between
the
Commissioners
and
the
staff.
So
I'll
give
you
your
full
15
minutes
in
a
very
short
time.
I
Thank
you
is
that
is
that
correct
that
it
was
provided
by
the
applicant.
K
I
K
Yes,
City
staff
agrees
with
the
recommendation
by
the
applicants
arborist
and
the
city's
arborist
through
their
review
of
the
tree,
and
review
of
the
report
also
agrees.
The.
I
B
Any
questions
over
here:
okay,
are
there
any
comments
on
staff
any
okay?
At
this
time
the
applicant
can
speak
and
I'm.
Sorry
I
had
to
cut
you
off
earlier.
So
we
have.
Will
you
I
believe
Tim's
sokolowski?
L
B
Can
I
ask
a
question
then
this
Holly
Oak
are:
are
there
plans
to
put
it
on
the
property
in
the
spot
where
the
oak
is
being
removed,
or
are
there
plans
to
donate
it
to
the
city
or
Park
and
Recs?
What
are
the
plans
for
that.
L
So
it's
kind
of
up
to
the
HOA
to
decide
what
and
where
they
want
to
do
the
planting.
At
this
point
it
hasn't
been
discussed
and
there's
been
no
conclusion
to
where
the
tree
is
going
to
go.
L
I
think
the
city
Arbors
probably
recommended
a
hollyoaks,
because
it's
a
smaller
Oak
than
a
Coast
Live
Oak,
so
even
if
it
does
go
back
in
the
exact
spot
or
close
to
that
exact
spot.
You
know
it's
not
going
to
be
an
issue
in
20
25
30
years,
because
it's
just
never
gonna
get
to
that
side.
L
So
it
can
definitely
be
put
back
into
place
where
the
existing
Oak
is
coming
out.
But
there
are
other
locations
on
the
property
that
they
could.
They
could
plant
it
as
well
so,
but
we
haven't,
they
haven't,
come
to
a
decision
on
where
exactly
they
want
it.
B
L
Yeah,
because
the
tree
in
question
that's
being
asked
to
be
removed,
is
the
canopies
on
the
oak
to
the
left
of
that
tree
and
the
right
all
kind
of
grow
together,
so
it's
already
crowded
in
that
area
as
far
as
the
canopies
and
coverage.
So
if
they
did
not
decide
to
put
a
tree
back
in
that
place,
there's
still
plenty
of
coverage
from
the
other
two
oak
trees.
D
F
Oh
hi,
this
is
John
Burke,
I'm,
the
city's
consulting
or
Everest.
F
Yes,
this
tree
the
I
recommended
the
hollyoak,
because
it's
more
as
a
more
traditional
straight
trunk,
where
the
Coast
Live
Oak
that
that
tree
appears
to
be
bending
to
try
to
find
some
light,
the
trees
on
either
side
of
it
are
dominant,
and
so
it's
like
an
understory
tree
and
the
the
trunks
just
curved
into
the
into
the
corner
of
that
deck.
And
you
know
probably
in
2013
it
wasn't
a
you
know.
They
didn't
even
pay
any
attention
to
it
and
over
time
it's
lifted
that
that
deck.
B
G
Mr
Burt's,
commissioner
link,
in
your
opinion.
If
the
deck
were
to
be
modified,
such
that
it
could
be
wrapped
around
the
tree
and
then
no
longer
the
tree
and
the
deck
would
no
longer
interface
with
each
other.
Is
the
tree
still
stable
enough
to
hold
itself
up
according
to
the
tree
report,
it
is
a
healthy
tree.
F
Well,
that's
that's
a
good
question
and
I
thought
about
that
myself.
F
F
It
would
be
expensive
to
modify
it
because
it's
actually
interfering
with
the
post,
not
just
with
the
deck.
So
it's
possible
whether
it's
appropriate
in
this
situation,
I'm
not
sure.
B
Okay,
go
ahead:
Mr
Link.
G
L
There
is
a
ton
of
weight
pushing
on
that
and
I
can't
imagine
that
that
it's
just
the
wood
decking
that's
being
damaged
when
something
is
pushing,
you
know
and
lifting
a
deck.
That's
you
know,
pre-portified,
that's
pretty
significant
damage
and,
as
far
as
you
know,
the
modification
of
that
deck,
all
those
decks
are
kind
of
uniform
along
that
side
of
the
street
and
I
I.
L
Don't
know
if
that's
even
a
possibility,
because
you
would
have
to
accommodate
for
further
growth
and
probably
further
tipping
of
that
that
tree
and
meaning
of
that
tree,
because
it's
dated
in
so
even
if
that
was
done,
I
would
I
would
think
that
would
be
a
temporary
fix
that
it
would
probably
have
to
be
Revisited
again.
Maybe
five.
You
know
five
to
ten
years.
The
same
issue
would
happen
not
only
that,
but
the
fact
that
it's
growing
into
the
deck
that
tree
is
now
not
jeopardized,
but
it
is
being
injured.
L
It's
growing
through
the
cambium
of
the
tree,
it's
affecting
the
flow
of
nutrients
and
Waters
and
canopy.
It's
not
showing
that
sign
right
now,
but
you
know
there's
a
foreign
body
growing
into
the
the
cavity
of
this
tree
now,
so
it's
kind
of
on
both
sides,
a
great
candidate
for
removal.
B
You
I
don't
know
if
anybody
else
walked
under
the
deck
and
I'm,
not
a
struggle
structural
engineer
by
any
means.
But
if
you
look
at
all
the
I
guess
you
call
them
joists
under
the
deck
two
over
from
the
corner,
it
was
significantly
lower,
it
had
been
displaced,
the
big
old
heavy
joist
had
been
displaced
by
probably
four
inches,
and
if
you
had
gone
on
the
deck
the
deck
had
sunk
in
that
area,
it
was
scary
for
me
to
walk
up
there
and
to
be
under
it.
Seeing
the
displacement
of
it.
B
I
don't
know.
If
anybody
else
did
that,
but
I
don't
know
anyways
any
other
questions.
Okay,
does
the
applicant
have
any
rebuttal
comments.
K
As
you
go
up
the
steps
it
serves
as
a
landing
for
four
different
units
and
that
where
that
tree
is
impacting
the
deck,
it
is
the
section
that
Services
the
end
unit
of
that
Landing.
So
by
altering
that
part
of
the
deck
and
attempting
to
leave
the
tree
there,
you
would
basically
limit
access
to
the
residence,
private
deck
area
and
front
door
so
which
is
also
enclosed
by,
like
a
three
foot,
high
gate.
M
If
I'm
HR,
just
just
to
make
sure
that
we're
all
clear
for
tonight,
the
application
was
was
by
the
arborist,
as
you
know,
and
it
is
specifically
for
this
permit
for
the
tree
removal
right.
So
that's
what
that
is.
What
is
in
front
of
you
I
understand
the
questions
regarding
this.
The
structure,
and
that
is
important
and
I,
think
those
questions
are
relevant
to
Future
activities
if
they
need
to
get
a
permit
for,
and
it
sounds
like-
maybe
they
do,
but
for
tonight.
I
B
Believe
the
the
applicant
said
that
the
homeowners
association
hasn't
decided
where
it
will
be
yet.
I
G
M
Yeah
I
think
that
is
a
discussion
that
we
need
to
have
to
make
sure
we're
clear,
because
I
agree
that
we
need
Clarity
on
that
and
reading
the
this
the
conditions
itself.
It
was
I
think
broad
enough.
That
was
going
to
say
that
again,
for
my
reading
of
it
as
well,
was
that
the
hollyoak
was
selected
because
of
its
nature
to
go
straight
and
it
was
to
go
back
into
the
location
where
this
tree
is
being
removed.
M
It
I
understand
the
memo,
so
that
was
my
initial
thought
process
for
that,
just
because
I
wanted
to
make
sure
that
we're
following
our
code
right
so
I
think
as
Mr
Gomez
mentioned.
It's
that
the
condition
was
to
place
it
on
site
and
so
I
think
he's
trying
to
make
sure
that
there's
coverage.
If
it
can't
go
in
this
one
location,
it
would
go
somewhere
on
the
site.
M
To
that
extent,
based
on
additional
comments
that
we
heard
tonight,
I
would
say
that,
and
we
just
need
to
confirm
either
with
Mr,
Gomez
or
or
Mr
Kearns.
If
he's
aware,
if
they
cannot
place
on
site,
is
it
automatically
a
defactor
that
it
goes
to
the
next
step,
which
would
be
to
either
pay
in-lu
fee
or
to
donate
a
tree
to
a
appropriate
Outside
Agency
such
as
crpd
or
Costco,
and
so
I
would
ask
either
Mr
Gomez
or
Mr
Kearns
if
they
can
give
us
information
on
that.
D
Sure
thank
you
Mr
here,
Mr
Ferris,
commissioner
Ferris,
the
ideally
we'll
get
the
tree
back
in
the
on
the
site
in
the
same
location,
but
they
have
to
do
the
removal.
Remove
the
trunk,
call
the
root
system
they're
prepared
at
the
site
for
accommodating
that
tree.
If
that
can't
be
accommodated,
then
we'll
look
elsewhere
on
the
property
and,
as
a
last
resort,
we'll
get
a
donation.
E
I
Right
so
I'm
reading
it
and
it
says,
condition
requiring
replacement
or
replacement
of
an
additional
oak
tree
trees
on
the
subject
property
or
at
an
appropriate
location
on
public
property
to
offset
the
permitted
removal
of
the
trees.
So
the
ordinance
is
Broad,
so
I'm
trying
to
understand
what
we're
articulating
with
respect
to
the
condition
I
mean
it
gives
us
the
wide
breadth
to
do
whatever,
but
I
think
I
would
like
to
lean
into
getting
the
tree
in
the
spot.
I
D
I
think
you,
commissioner
Ferris
the
commission
certainly
can
add
more
language
to
the
condition
to
strengthen
it.
If
that's
what
the
commission
chooses.
I
B
Okay,
so
this
question
is
for
the
applicant,
would
you
agree
if
we
change
the
condition
to
reflect
that.
B
L
B
M
Yeah
I'm
I'm
struggling
a
little
bit
because
I
think
we're
just
trying
to
make
it
simple
and
put
it
at
the
end,
but
I
think
just
at
the
end
of
condition
number
three,
we
would
add
the
tree
replacement
shall
be
planted
on
site
where
the
current
trees
to
be
removed
unless
the
city's
arborist
opines
that,
after
reviewing
the
conditions
of
the
location
after
the
trees,
current
tree
is
removed.
M
He
finds
that
placing
a
tree
at
that
location
would
not
be
successful
for
the
current
for
the
new
tree
to
be
put
in
sorry,
that's
a
little
rambling,
but.
B
Sounds
great.
Okay,
thank
you
is
that
all
right
with
the
commissioners
all
right,
all
right,
okay,
where
are
we
did
the
applicant,
have
any
rebuttal
comments.
B
Thank
you
very
much
for
your
patience.
Okay,
now
I
will
close
the
public
hearing
and
I
will
open
up
the
floor
for
discussion
and
or
a
motion.
G
I,
don't
think
I'm
about
to
make
a
motion
here,
but
I
just
wanted
to
add
a
discussion,
I
think
in
this
situation.
We
may
be
putting
the
cart
before
the
horse
a
bit
based
on
the
boast.
Arborists,
the
cities
and
the
applicant
that
we're
talking
about
a
healthy
tree.
There's
no
indication
that
the
tree
would
fall
over.
There
is
going
to
need
to
be
modifications
to
the
deck
slash
balcony
as
a
result
of
the
damage
created
by
the
tree.
G
The
damage
has
been
gone
going
and
it
sort
of
thinks
it
sounds
like
the
the
RPD
or
the
HOA
sort
of
let
this
get
away
from
them
and
to
me
it
would
seem
that
there
are
other
ways
of
going
about
this,
perhaps
modifying
the
balcony.
Is
it
that
construction
already
needs
to
occur
to
find
a
way
to
accommodate
the
tree?
I
mean
based
on
my
viewing
of
the
tree.
It
doesn't
look
like
it's
being
muscled
out
so
to
speak
by
the
adjacent
trees.
G
I
I
think
we're
sort
of
trying
to
fit
in
a
new
tree
where
the
tree
may
not
be
occurring.
If
it
is
in
fact,
as
we're
getting
kind
of
contradictory
information
here,
if
there,
if
we
do
have
two
adjacent
trees
that
are
apparently
over
topping
or
or
squeezing
out
this
existing
tree,
will
then
replacement
of
the
new
tree
may
not
be
even
a
modification?
The
other
thing
I
don't
see
is
whether
and
because
this
is
categorically
exempt.
D
M
The
way
that
this
particular
rule
is
for
this
issue
is
that
have
they
established
that
it's
causing
damage
either
to
person
or
to
property
right,
so
that
is,
and
it's
because
of
the
size
that
is
coming
before
you
so
I
understand
that
you,
you
you're,
reviewing
the
the
health
of
the
tree,
but
that
what
the
applicant
is
asking
for
is
that,
based
upon
the
fact
that
this
tree,
whether
it's
healthy
or
not
healthy,
is
causing
the
damage
he's
asking
that
it
be
removed,
and
that's
what's
that
one
code
section
that
he
we're
using
it
permits
him
to
do
so
that
that
is
what's
before
you
and
I
understand.
M
You
know
the
health
of
the
trees
is
a
factor,
but
for
this
particular
except
option
it
it
doesn't
matter
whether
or
not
the
tree
is
healthy
or
not.
It's
it's
more
of
is
that
tree
causing
the
damage
that
is
occurring
and
that's
why
they're
asking
for
the
exception.
B
Any
other
comments
do
I,
have
a
motion.
E
You
chair,
it
is
difficult
and
in
fact,
I
wanted
to
recognize
the
comment
from
one
of
our
citizens
kind
of
saying
a
lot
of
the
same
things
in
terms
of
this.
It's
interesting
in
the
years
I've
been
here,
we've
had
a
few
situations
where
the
trees
were
planted
afterwards,
and
they
were
not
right
for
the
area.
All
of
a
sudden,
they
put
these
huge
trees
in
a
little
tiny
box.
E
But,
oddly
enough
and
and
not
trying
to
be
ironic
at
all,
is
you
would
then
limit
the
amount
of
the
outdoor
decking
in
the
outdoor
space,
which
is
what
we
were
concerned
about
in
terms
of
some
of
our
other
process
of
kind
of
looking
at
that
I
think
at
the
end
of
the
day.
Yes,
we
want
to
preserve
the
tree,
but
I
think
in
this
situation.
The
tree
has
caused
such
problems
with
regard
to
this
issue.
E
I
think
trying
to
kind
of
get
around
it
so
to
speak,
and
literally
maybe
creating
more
issues
so
I'm
going
to
make
the
motion
to
go
ahead
and
if
I
can
get
to
the
page,
because
I
know
I
have
to
say
the
whole
thing
page
there
I
should
have
been
prepared.
Sorry
about
that,
let's
see,
find
the
project
categorically
exempt
under
sequa
and
approve
or
adopt
the
resolution
approving
PTP
2023-70030,
based
on
the
findings
substitute
the
condition,
including
the
additional
language
Mr
Heater,
provided
for
condition.
Three.
B
Thank
you.
Are
there
any
comments
on
the
motion,
commissioner,
Ferris.
I
Thank
you
I
think,
any
time
that
we
are
asked
to
remove
one
of
the
the
namesake
trees
that
you
know
bestows
the
name
in
our
city.
It's
it's
one
that
we
should
take
extremely
seriously
and
I.
Think
that
that's
what
the
oak
tree
ordinances
have
have
done
to
me.
The
evidence
unfortunately
does
warrant
that
it
meets
the
conditions
of
causing
or
in
potentially
leading
to
even
more
substantial
damage
to
the
structure
to
where
the
the
permit
would
be
warranted.
I
The
main
thing
I
want
to
make
sure
of
is
that
we
apply
the
mitigation
measure
that
says
you're
going
to
keep
a
tree
there
not
use
it
as
potential
precedence
for
other
opportunities
to
remove
oak
trees
to
where
they
can
just
get
rid
of
the
tree
and
plant
it
elsewhere.
So
that's
one
of
the
things
that
I
wanted
to
make
sure
of
I'm
glad
to
see
the
additional
language
and
that
the
applicant's
okay
with
that
and
for
these
reasons,
I'll
support
the
motion.
I
B
I
will
add
to
that.
I
do
agree
with
a
lot
of
what
you
said
and
a
lot
of
what
you
said,
but
my
own
personal
opinion
is
I'm
concerned
that
that's
just
not
the
right
spot
for
another
tree,
because
you've
got
the
two
trees
next
to
it.
You've
got
maybe
not
enough
light
for
it
and
I
I
would
like
it's
not
my
decision.
I
would
like
to
see
it
elsewhere
on
that
property,
I'm
thinking
that
it's
too
crowded
now
for
a
tree,
but
I'm
not
an
arborist.
B
B
You
and
thank
you,
staff
that
was
a
good
report.
Any
aggrieved
party
who
wishes
to
appeal
the
planning
commission's
decision
may
do
so
by
filing
an
appeal
within
the
with
the
Community
Development
Department
within
10
days.
Thank
you.
Everybody.
Let's
see,
we
are
at
item
number,
eight
Department
reports.
Do
we
have
any.
B
D
The
May
22nd
meeting
does
not
have
any
items,
so
it
will
be
canceled.
However,
on
June
5th
there
will
be
two
public
hearings,
one
for
mixed
use
project
just
mentioned,
going
to
City
Council
on
20th
for
the
latico
Hillcrest
development
and
another
application
for
our
new
120
square
foot.
120
000
square
foot
industrial
building
over
in
the
Rancho
Canada
area,
and
that
is
all
the
updates.
B
Thank
you
and
up,
commissioner,
my.
G
Apology
is
going
to
make
us
go
backwards.
I
would
be
remiss
if
I
didn't
mention,
especially
since
the
22nd.
G
It's
going
to
be
canceled,
that
May
21st
to
the
27th
is
National
Public
Works
week
and
I
will
actually
be
at
Council
tomorrow
night
presenting
the
city
of
Thousand
Oaks
I'm,
letting
the
cat
out
of
the
bag,
but
the
agenda's
already
been
posted,
but
several
Awards
to
the
city
of
Thousand,
Oaks
I
won't
tell
you
what
they
are,
but
you
and
there
will
be
a
proclamation
tomorrow
night
declaring
National
Public
Works
week,
May
21st
to
the
27th.
So.
