feet,
minimum

lot

for

property

This

submitted

These
documents
are
not
official
records
of
survey,
nor
are
they
boundary
surveys
that
they
were
not
signed
by
an
engineer

recorded

the

site,
the
building
setbacks,
are
required
to
be

feet
from
stress
center
line
of
each
street.
In
this
case,
the
building

convenience
store

is

Since
the
packet
was
completed,
staff
has
received
several
more
correspondence,
letters
and
emails

supplemental
packets.

approving
this
type
of
special
use
permit,
the
commission
must
make
all
of
the
following
findings
and
I'll
read
them
each
that
the
project
is
consistent
with
a
thousand
external
plan
and
any
applicable
specific
plan
and
redevelopment
plan.
In
this
case,
it
is
consistent
with
the
thousands
general
plan.

The
three
italicized
are
the
three
that
the
basis
of
staff's
recommendation
are
on
that
the
project
complies
with
all
applicable
laws,
regulations
and
policies,
including
thousands
municipal
code.
In
this
case,
the
applicant
is
seeking
two
waivers:
the
minimum
wage
size
for
service
stations,
as
well
as
a
setback
waiver
on
the
kai
jasmine
street
frontage.

the
project
will
not
be
detrimental
to
public
health
safety.
General
welfare
due
to
the
24-hour
nature
of
the
operation,
it
will

noise
impacts,

not
typical
area
and
that
the
proposed
use
of
the
proposed
location

compatible

the
vicinity
and
based
on
the
architectural
design
and
the
operations
at
the
staff
has
determined
it's
not
compatible.

conclusion,
staff

lot
does
not
mean
the
minimum
loss
size
for
service
stations,

the
setback
waiver
is
not
appropriate.
On
the
kai
jasmine
side,
the
roofing
material
is
incompatible
with
materials
in
the
area.

24-hour
operation
will
create
noise.

not
typical
for
the
surrounding
area
that
the
overall
operation
is
too
close
to
residential
having
the
nearest
residential

the
location

in
close
proximity

could
result
in
congregate,

the
site

therefore
staff

recommending

planning
commission
deny

special

permit.

station
and

is

was
built

think
there's
some

is
underserved
with
gas

serious
safety
concerns
for
the
students
attending

high
school
across
the

community

against

of

really

within
shouting
distance
of

windows

with
people's

as

belongs

to

community
meetings

one

that
they

on

pretty

to
