On Wednesday, March 1, 2023 a Business Licence Hearing will take place in the Council Chamber to determine whether the Chief Licence Inspector’s decision to cancel the business licence (“Business Licence”) issued to Chi Wah (Shirley) Pang (the “Licencee”) for a short-term rental accommodation at 1397 West 41st Avenue (the “Premises”), should be upheld, overturned or attach conditions to the Business Licence.
Robert LeBlanc, Lawyer, Legal Services, will represent the City of Vancouver. Chi Wah (Shirley) Pang will represent herself.

by
the
licensee
of
the
chief
license
inspector's
decision
to
cancel
the
business
license
issue
to
her
for
the
2023
business
year.
You
can

rental
accommodation
at
1397,
West,
41st
Avenue,
the
cancellation
by
the
chief
licensed
inspector
and
the
basis
therefore
is
set
out

paragraph
sets
out
that
the
basis
of
the
cancellation
was
due
to
the
licensee
having
been
convicted,
of
a
contravention
under
section
25.171
of
the
City's
License
bylaw.

suspension
is
set

authority
of
section
4
sub
3
of
the
City's
License
bylaw,
which
is
reproduced
in
the
letter
and

Just
read
that
for
the
panel
on
receipt
of
an
application
and
before
issuing
any
license
they're
on
the
inspector
and
that's
the
chief
license,
inspector
I
shall
ascertain
whether
the
applicant
has
it
anytime,
within
the
preceding
five
years,
been
convicted
of
any
offense
under
any
statute
of
Canada,
the
province
of
British,
Columbia
or
elsewhere,
or
under
any
bylaw
of
the
city
of
Vancouver
and
the
inspector.

think
that
what
this
panel
can
glean
from
sections
force
of
three
of
the
licensed,
bylaw
and
section
277
of
the
Vancouver
Charter
is
that
the
panel
has
a
discretion
to
review
the
decision
of
the
chief
license
inspector,
and
that
again
is
the
purpose
of
today's
proceeding.
The
city's
only
witness
today
is
the
city's
deputy
chief
licensed
inspector
Mr
Koji
Miyagi,
who
will
walk
the
panel
through
the
materials
in
the
evidence
book
that's
been
provided
and
we'll
explain
the
basis
for
the
chief
license
inspectors
decision.

the
witnesses.

license
inspector

the
city
of
Vancouver
I'm,
also
the
deputy
director
for
Community
standards
and
in
that
area,
I
oversee
three
branches
of
bylaw
enforcement
for
the
city
of
Vancouver.
Two
of
them
are
involved
in
a
short-term
rental
compliance
enforcement.

the

licenses
are
issued
online
and
so
an
individual
can
obtain
a
license
if
it's
their
first
application
or
even
through
renewals,
so
those
are
issued
as
they're
issued.
Our
staff
will
then
take
a
look
at
various
files
and
in
this
particular
case
we
began
a
we
call
it
either
a
phase
one
audit
or
a
paper
audit,
where
we
check
for
documentation
that
proves
their
primary
residence
status
and
things
that
support
the
compliance
as
written
in
the
bylaw.

at
the
files,
there
was
a
complaint
about
an
illegal,
short-term
rental
activity
going
on
at
this
address,
so
we
we
dispatched
James
and
in
that
process
he
discovered
a
number
of
violations
at
that
premise,
not
just
an
illegal
short-term
rental,
but
also
a
zoning
violation
of
of
of
some
severity.
We
discovered
a
illegal
rooming
house
operation
going
on
at
the
premise,
so
those
are
room
rentals
that
shouldn't
be
happening.

operation
there,

would
have
been
no
permits
or
licenses
issued
to
to
conduct
that
activity.
The
the
property
would
have
not
been
zoned

property

have
been
congruent
to
having
a
rooming
house
operations
there
and.

to

actual
property

are
reasons
for
that
and

state
that

but
this
is
a
very
large
one
building.

visited
that
location
it,
it
was
planned
and
zoned
as
a
single
residential
unit,
but.

rooming
houses
would
have
likely
indicated
bedrooms
that
were
created
in
spaces
that
were
likely
not
not
likely,
but
they
weren't
supposed
to
be
bedrooms,
but
on
the
original
plan
they
were,
they
were
large
rooms
or
storage
rooms.
What

but
they
were
then
converted
into
bedrooms.
There
were
locks
on
the
doors
and
there
were
railings
on
the
windows
and
those
are
safety
concerns.
The
basement
is
also
below
six
foot,

which
raises
a
life
safety
issue.

alterations
and

she
miss
Pang
had
voluntarily
given
up
her
license,
but
then
we
find

short-term
rental
booking
activity
solicitation
on
the
Airbnb
sites
for
unlicensed
short-term
rental
activity.

listings

the
listings
are
taken
down

what
happens
in
that

we

follow

non-compliant
activity,

property
owner
hasn't
been
moving
along

escalation,
steps
that
we
are
taking
from
both
on
a
short-term
rental
side
of
things
and
also
on
the
property
use
side
of
things
and
then
in
April
and
June
of
2021.

receive
another
complaint
about
short-term
rental
activities
that
are
going
on
in
the
basement
of
this
property,
which
we
spoke
about
earlier
to
her.
And
so
then
we
prompted
another
investigation
on
there
and
found
out
that
that
she
has
been
listing
and
and
so
right
away.
We
issue
a
another
license
Order
season.

And
this
this
this
the
sort
of
bold
disregard
for
our
laws
and
she
has
been
in
contact
with
our
Pui
inspector,
so
lots
of
contact
with
the
city,
and
so
we
we
upheld
the
the
ticket
and
incited
that
her
history
with
us.
Recent
history
and
ongoing
history
was
the
reason
why
we
did
not
cancel
that
ticket.
At
that
time.

activities

this
location
just

due
diligence
and

July

August,
so

just
the
next
month
from
June,
she
continues
to
list
and
continues
to
receive
bookings

illegal
short-term
rental

are

found
at
that
time,
and
so
we
resort
to
the
highest
form
of
compliance
measure
that
we
have
on
hand
with
the
city
and
that's
to
refer
this
individual
in
this
case
well
to
prosecution.

the
notes,
she
may

actually

concurrent
bookings
in
January
and

that's
a

huge
violation
of
short-term
rentals
well,
notwithstanding
not
having
a
valid
license
but
having
concurrent
bookings
as
well
would
be
a
in
our
mind,
a
fairly
egregious
and
serious
disregard
for
the
for
the
laws
that
we
have.

for
a

short-term
rental
business
license
she
applied
on
December
12
or
it
was
issued
December
12th,
so
she
must
have
applied
around
that
time
and
we
were
a
little
bit
surprised
that
that
was
done
immediately.
We
started
to
open
up
another
investigation
on
this
one
to
now.
There
is
a
letter
that
we
issued
that
talked
about
providing
us
documentation
and
whatnot,
and
that's
a
standard
letter
that
we
issue
to
applications
that
we
get
and
I
suppose.

we
probably
could
have
sent
her
a
cancellation
letter
at
that
time.
We
did
do
so
January
5th
2022,
it's
a
very
quick
turnaround.
If
you
look
at
December,
12th
is
when
the
license
was
issued.
There
was
Christmas
involved
in
there,
but
by
December
by
January
5th,
we
had
issued
a
letter
of
cancellation
to
her.

if
I'm
wrong,
the
the
application
was
was
made
in
December
22.
It
was
processed
automatically
and
the
the
license
issued,
but
it
was
then
quickly
flagged
by
staff
and
then
reviewed
by
the
chief
license
inspector
for
a
determination
of
whether
or
not
it
should
have
issued
in
the
first
place,
I've
heard
to
say.

we've
gone
through,
some
of
the
passages
in
that
letter
of
January
5th
at
Tab,
10,
page
39,
and
what
the
chief
license
inspector
is
saying
in
her
letter
is
that,
given
the
convictions
in
April
2022
of
of
an
offense
of
carrying
on
short-term
rental
accommodation
without
having
the
required
business
license,
she
was
of
the
view
that
the
current
application
she
was
obliged
to
to
cancel
that
it
never
should
have
been
issued
in
the
first
place.
In
other
words,.

order
for
her
to
have
that
booking
in
January,
we
we
suspect
she
must
have
been
listing
in
December
as
well
and
to
the
amount
that
she
has
the
bookings
and
there's
four
or
five
and
there's
one
booking.
That
information
says
that
this
individual
was
there
for
three
weeks
so
and
then
another
review
in
January
states
that
there
were
noises
and,
and
there
were
activity
and
and
whatnot.
That
leads
us
to
believe.

again,
there
were
concurrent
bookings,
so
so
with
that
said,
even
though
we
had
a
center
second
prosecution,
even
though
we
had
said
no,
your
your
license
is
canceled.
She
continued
to
to
have
the
bookings
Beyond
January
5th,
our
letter
that
was
sent.
She
responded
to
us,
January
10th,
so
she's
aware
that
she
does
not
have
a
license
and
yet
continued
to
have
this
activity
fairly
aggressive
activity
to
a
point
where
we
also
suspect.

her

listings
will
show
30
plus
days,
so
if
I
can
advance
to
February
2023,
our
Alexander
Holmes
is
our
coordinator
of
short-term
rental
enforcement
and
she
spent
some
time
speaking
with
Miss
Pang,
trying
to
explain
to
her
why
we
canceled
the
license
the
obligations
of
the
the
chief
licenses
inspector.
But
through
this
conversation,
Ms
Holmes
was
trying
to
ascertain
how,
in
what
Manner
would
miss
Peng
be
running
a
short-term
rental
anyways
like
how
do
you?

How
do
you
plan
to
do
this,
and-
and
it
wasn't
clear
to
us
through
that
explanation
that
Mr
Holmes
provided
she
was
confused
in
terms
of
how
her
permanent
or
primary
residence
was
going
to
work?
And
in
addition
to
that,
when,
when
she
contacted
us
on
January
10th
to
say
that
I
like
to
appeal
this
on
January
16th,
there
was
an
application
for
a
short-term
rental
license
on
the
same
address
from
a
from
a
Jessica.

we

no
idea
who
this
individual
is
and
somehow
she
lives
there
now
and
is
applying
for
a
short-term
rental
license.
And
so,
with
all
this
information
that
that
became
available
to
us
and
we
we
were
suspect
of
the
timing.
Perhaps
this
individual-
and
this
has
been
seen
in
the
past
where
somebody
has
used.
Somebody's
name
is
used
to
just
get
a
license,
and
so
we
investigated
that
further
to
the
extent
that
I
don't
go
out
all
the
time.

with
Miss
Pang
on
the
24th,
and
that
summary

provided
as
supplemental
information

your

I'm
not
quite
sure
what
page
it

But
it
was

second

going

the
highlights
were
that
we
were
there

hesitant

how

living

particular
fridge
was
completely
empty.

were
void
of
any
regular
use.

the

applying

a
short-term
rental
license
to
prove
private
residency.

notice
a
lot
of
laundry
of
bed
sheets
all
over
the
house
we
get

basement
and
in
the
basement,
once
again
is
turned
into
a
rooming
house.
There's
locks

doors,

on
the
doors,
according
to
the
plans
that
I
have
that
was
approved
by
the
city
and
submitted
to
the
city.
Those
are
supposed
to
be
storage
rooms
and
rec
rooms.

takes
fairly
seriously

spent

this
money
creating
two
legal
dwelling
units,

yet
she
still
treats
it
as
as
one
house,

how
we
see
it.
So
it's
still
not
clear
to
me
and
I've
reviewed
hundreds,
thousands
of
case
files
in
terms
of
how
an
individual
operates.

short
term
rental
and
I
I
do
not
understand
how
she
plans
to
operate
short-term
rental
if
she
was
ever
granted
a
lot
of
a
license.
But
it
is
one
of
my.

Unique
cases
where
I've
seen
this
many
egregious
violations
and
disregard
for
the
regulations
as
a
as
a
case
file
for
short-term
rentals,
and
so
when
I
saw
the
violations
too.
I
immediately
asked
my
property
use
inspectors
to
investigate
the
rooming
house
and
the
illegal
work
without
permit
that's
going
on,
and
so
my
understanding
is
March
10th.
There
is
a
detailed
access
order
that
is
going
to
happen
at
Miss
pang's
residence
to
to
check
all
the
rooms
and
all
the
spaces
brand
new
future
violations.

the

on

by
the
sounds
of
it

to
