concerns
regarding
an
increase
in
the
difficulty
of
policing
customers
who
choose
to
consume
alcohol
whilst
queueing
to
enter
the
venue
and
customers
attempting
to
attempting
to
secrete
alcohol
on
entering
the
venue,
whilst
other
concerns
related
to
behavior
and
littering
problems.

the
license

following
areas:
a
brief
background
of
tesco's,
the
application
itself
I'll
deal
with
the
representation
and
then
finally,
a
brief
summary.
So
today
we
do
see
the
granting
of
the
application
as
applied
for
for
zero
600
until
midnight.

In
the
extensive
licensing
policies
and
due
diligence
processes,
there
are
approximately
half
a
billion
alcohol
sales
transactions
completed
by
tesco's
each
year
and
in
terms
of
the
individual
store
turnover
for
alcohol
is
between
seven
and
fifteen
percent
for
alcohol
sales.
So
tesco's
were
one
of
the
very
first
supermarket
retailers
and
one
of
the
very
first
operators
to
run
its
own
british
institute
of
innkeeping
bii,
accredited
training
centers
with
a
recognized
level
of
tesco
training
being
excellent.

Moving
on
to
training
specifically,
there
are,
as
you
would
imagine,
written
training
policies
and
formal
training
programs
in
all
stores
that
sell
alcohol,
which
ensures
that
staff
are
equipped
to
meet
and
promote
all
licensing
objectives.

Training
is
carried
out
with
every
individual
member
of
staff
when
they're
interrupted,
inducted
and
refresher
training
takes
place
twice
a
year
out
before
easter
and
before
christmas.
Obviously
the
busy
periods
or
whenever
there
are
major
changes
to
the
legislation.

The
express
format
itself,
so
the
subject
of
this
application
is
an
express
store
and
it
is
designed
to
be
a
convenience
store
for
local
people
in
the
surrounding
area.
Not
only
will
the
customers
be
local
but
so
to
the
staff
be
with
the
majority
of
the
20
people
employed
coming
from
the
leeds
area,
the
store
manager
and
dps
as
yet
has
not
been
chosen,
but
as
a
city
centre
store,
they
will
be
experienced
paul.

Who
is
on
the
call
and
able
to
take
questions
as
the
area
manager
and
has
been
an
area
manager
for
tesco
for
five
years
and
has
held
his
personal
license
for
18
years,
so
it's
very
experienced
in
the
licensing
act.
Paul
will
oversee
this
store,
as
well
as
the
other
eight
city
center,
tesco
express
stores
in
leeds.

Turning
then
to
the
application
itself,
as
stated
it's
from
0-600
until
midnight,
the
standard
express
formats
store
hours,
and
these
are
for
shoppers
convenience
land
shoppers
to
buy
alcohol
whenever
the
store
is
open.
Obviously,
in
the
modern
world,
with
the
24-hour
way
that
we
live.

The
reason
those
hours
have
been
applied
for
is
so
that
whenever
the
store
is
open,
people
can
purchase
alcohol,
and
especially
this
works
in
the
covid
times.
Where
we
don't
want
people
making
two
journeys
in
order
to
buy
alcohol,
should
they
wish
to
cha
you'll,
no
doubt
all
be
aware
of
paragraph
1015.

The
current
section,
182
guidance
that
states,
shops,
stores
and
supermarkets
should
normally
be
free
to
provide
sales
of
alcohol
for
consumption
off
the
premises
at
any
time
when
the
retail
outlet
is
open
for
shopping,
unless
there
are
good
reasons
based
on
the
licensing
objectives
for
restricting
those
hours,
and
this
is
also
echoed
in
the
leeds
city
council
statement
of
licensing
policy
of
paragraph
613.

As
you'll
be
aware,
the
responsible
authorities
have
all
been
provided
with
copies
of
the
application
made
and,
as
mr
nelson
stated,
there
was
a
representation
from
west
yorkshire,
police
and
indeed,
conditions
have
been
agreed
and
I'll
touch
upon
those
later.
But
we
would
say
that
this
is
a
sign
of
the
confluence
that
they
have
in
tesco's
ability
to
adhere
to
and
promote
the
licensing
objectives.

Due
to
the
number
of
stores
that
tesco
has.
In
the
leeds
area,
not
just
the
city
center
hardish
has
built
up
a
relationship
with
pc
cathartical,
so
that
should
there
be
any
issues,
pc
cathartical
will
go
directly
to
hardish
if,
if
any
issues
were
to
arise
such
as
that
relationship,
turning
now
to
the
representation
itself-
and
we
would
say
that
this
is
a
trade
objection
and
a
number
of
points
were
raised
in
it
and
I'll-
I
will
deal
with
them
as
I
go
through
it.

So
the
initial
query
issue
is
that
the
store
will
be
situated
at
the
rear
of
the
o2
at
portland
crescent.

So
I've
got
it.

You'll
see
the
location
and
the
o2
entrance
and
you'll,
probably
all
be
aware,
is
the
portland
gate
cookerage
street
at
the
bottom
left.
However,
the
entrance
store
to
the
tescos
is
on
the
northern
tip
of
the
portland
crescent,
approximately
where
it
says
tunnel
in
small
writing.

So
just
to
make
you
aware
there
is
a
fair
distance,
we'd
estimate,
probably
105
meters,
if
you
were
to
walk
directly
via
cook
ridge
street
up
to
the
entrance
of
the
tesco
store.
It's
our
belief.
I
haven't
been
out
to
the
to
the
academy
for
quite
some
time,
but
normally
cues
form
around
the
portland
gate
street
and
then
start
coming
down
the
portland
crescent.

Is
also
in
location,
the
location
of
the
store
being
up
at
the
northern
tip.
We
believe
that
most
customers
of
the
o2
will
be
coming
from
the
central
hub
where
the
transport
location
is
in
the
south
of
the
city
and
indeed
where
all
the
bars
are
so
before
people
go
to
their
night
out
at
the
o2
they'll
be
in
the
in
the
city
center
and
therefore
won't
venture
north
towards
us,
and
therefore
we
don't
believe
there
will
be
customers
utilizing
that
store.

So
this
to
us
doesn't
make
sense
as
an
operator,
they
will
be
aware
that
once
a
customer
has
purchased
its
goods
and
left
the
vicinity
of
the
premises,
it
will
be
on
the
direct
control
of
that
premises
and
indeed
that's
something.
The
o2
themselves
argue
within
their
representation.

I'm
also
not
certain
that
any
other
nearby
supermarkets
have
had
their
licenses
curtailed
due
to
their
proximity
to
the
o2,
and
indeed,
as
soon
as
that
person
enters
the
o2q
all
the
ot
premises.
They
will
become
the
responsibility
of
the
o2.

The
next
point
mentions
that
the
o2
will
have
issues
identifying
underage
drinks
and
proxy
sales,
as
I've
mentioned
previously.
Tesco's
have
very
very
robust
procedures
in
place
and
training
at
all
levels
with
the
staff,
but
I
can
confirm
that
training
does
specifically
deal
with
underage
sales,
proxy
sales
and
indeed
section
142
sales
to
those
that
are
drunk.
Indeed,
also,
all
members
of
staff
are
trained
in
conflict
management.

It
is
alleged
this
will
lead
to
unwelcome
crime
and
disorder
incidents,
but
no
evidence
has
been
put
forward
to
support
this,
so
the
alleged
issue
of
tesco's
becoming
a
magnet
if
they're
open
at
0-600
again,
we
believe,
will
be
unfounded.
We
have
looked
at
the
events
calendar
for
the
o2
for
the
forthcoming
year
and
of
that
only
six
were
late.
Night
finishes
in
the
late
curfew
to
zero.

Six
hundred,
however,
we
state,
even
if
they
were,
if
there
were
more
tescos
as
explained,
do
have
robust
policies
in
place
to
ensure
that
alcohol
will
not
be
sold
to
those
that
are
drunk
indeed
in
terms
of
loitering
tesco's.
Do
not
believe
this
will
be
an
issue,
obviously,
because
they
are
located
north
of
the
premises.
Those
having
been
to
the
o2
will
be
dispersed,
dispersing
south
towards
all
the
transport
hubs
to
take
them
home.

Indeed,
the
operating
schedule
reflects
the
fact
that
this
premises
is
a
small
convenience
store
and,
although
in
the
cia,
it's
not
in
a
red
zone,
it
should
be
noted
that,
in
relation
to
considering
the
application
in
the
cia,
as
set
out
a
paragraph
7.37
of
the
leeds
city
council
statement
of
licensing
policy,
it
can
be
confirmed
that
this
a
is
a
small
premises

that
it
will
operate
before
midnight
and
c.
Is
not
alcohol

It
is
purely
a
convenience
store.

representation
from
mr
cry
was
dated
the
5th
of
february.
So
at
that
stage
he
won't
have
seen
the
extra
conditions
that
have
now
been
agreed
with
the
police
that
took
place
on
the
11th
of
february.
But
hopefully
these
should
give
mr
cry
and
the
o2
further
comfort
should
it
be
needed.
If
I
could
just

those
those
are

to

But
just
by
way
of
summary,
the
the
extra
agreed
conditions
include
the
keeping
of
training
records,
cctv,
full
conditions.

There
is
an
instant
report
log
that
there
is
a
bazel
radio
and
that
there
be
a
member
of
management
on
the
premises
at
all
time.
The
store
is
open.
These
we
say
ensure
that
the
licensing
objectives
are
not
only
promoted
but
would
ensure
that
no
extra
cumulative
impact
takes
place
in
the
final
part
of
the
o2
letter.

It
was
being
requested
that
tescos
have
that
if
the
license
is
granted
have
their
hours
clipped
or
indeed
also
have
door
staff,
we
do
not
feel
that
these
measures
are
appropriate
and,
as
explained,
the
police
have
not
asked
for
these
measures.
Indeed,
we
say
the
committee
will
be
aware
of
section
182
guidance
that
state
the
police
remain.
The
key
enforcers
of
the
licensing
law
and
licensing
authorities
should
look
at
the
police
as
the
main
source
of
advice
on
crime
and
disorder.

So
that
the
committee
is
aware,
tescos
do
conduct
regular
risk
assessments
across
all
their
stores
across
all
the
estate,
and
should
any
of
these
alleged
concerns
be
raised
or
be
an
issue
or
become
an
issue.
The
necessary
steps
will
be
taken
to
adhere
to
them.
Indeed,
the
ball
lane
tesco
express
door
based
in
the
city
center
in
the
red
zone
does
not
have
an
sia
door
staff
condition.

The
final
point
I'd
like
to
make
is
that,
interestingly,
it
states
the
o2
representation
and
I'm
quoting
verbatim
our
clients
would
not
have
any
legal
responsibility
for
controlling
customers
of
tesco's
who
purchase
alcohol
in
the
early
hours
of
the
morning
or
at
any
part.
For
that
matter.
It
therefore
seems
perverse
that
the
ot
think
that
tesco's,
once
a
customer
has
left
their
premises,
should
have
a
responsibility
for
customers,
the
o2
who
may
go
and
queue
for
an
event
at
the
o2.

and,
as
described,
the
police
have
agreed
conditions
and
did
not
see
the
need
for
reducing
hours
or
indeed,
for
an

condition.
