The Committee on Housing, Neighborhood Development and The Homeless of the Council of the City of Philadelphia held a Public Hearing on Friday, May 29, 2020, and recessed the public hearing until Friday, June 5, 2020 at 9:30 AM.

In
the
midst
of
the
cogut
19
pandemic.
A
crisis
that
here
in
the
United
States
is
disproportionately
infecting
and
killing
black
people.
Seeing
a
black
life
taken
with
such
disregard
and
disrespect
by
an
agent
of
the
state
charged
with
protecting
us
was
a
spark
that
reignited
a
movement,
a
movement
against
police
brutality
and
against
the
systems
of
oppression
that
have
stopped
black
people
in
this
country
for
generations
and
housing
is
an
area
where
the
effects
of
this
oppression
are
crystal
clear.
Before
this
crisis
even
began,
Philadelphia
had
the
fourth
highest
eviction
rate
in
the
country.

They
give
renters
struggling
as
a
result
of
this
crisis
time
and
protection
while
putting
their
lives
back
together
so
that
they
don't
have
the
traumatic
threat
of
homelessness
hanging
over
their
heads
day
after
day
as
elected
officials.
In
this
period
of
upheaval,
we
have
a
unique
opportunity
to
affect
change
here.
Legislation
is
among
the
most
powerful
tools
we
have
to
combat
structural
racism
and
we
should
leverage
it
today.
Council,
members,
Jim,
Brooks
and
I
are
the
ones.

You
know
since
since
we've
started
from
this
legislation
as
a
bridge
between
the
chief
sponsors
and
the
real
estate
community,
I
want
to
thank
councilmember,
Gilmore
Richardson,
who
has
talked
to
us
extensively
about
every
one
of
these
bills
and
and
worked
with
us
on
our
amendments
and
I
want
to
thank
everybody
on
the
committee
for
getting
to
where
we
are
today.
I
also,
you
know
we're
in
a
heated
time
in
the
city
and
across
the
country
and
we're
hearing
everyday
from
members
of
the
public.

We've
gotten
thousands
of
emails
over
the
past
week,
or
so
about
people's
passions
on
police
brutality
and
and
on
the
city
budget.
But
you
know
I
want
to
encourage
us
to
have
respectful
conversations
and
I
also
want
to
emphasize
that
on
this
committee
and
on
council
we
are
colleagues
and
we
are
working
together
for
the
benefit
of
all
of
our
mutual
constituents
in
the
city.
I
also
want
to
say
that
we've
done
a
tremendous
amount
of
outreach
in
getting
these
bills.
Together,
we've
talked
to
numerous
property
owners
and
landlord
associations.

We've
talked
to
legal
aid
organizations
with
activists
with
renters
with
court
officials
with
faking
birds,
and
you
know
so.
Last
week
we
winded
up
holding
this
hearing
because
we
wanted
everyone
to
have
an
adequate
opportunity
for
feedback
and
an
adequate
opportunity
to
digest
the
amendments,
and
this
week,
I
truly
feel
that
we've
got
done
the
work
to
really
have
a
substantive
conversation
and
hopefully
a
successful.

so

know
I
just
want
to
say
that
this
is
a
moment
with
everything
going
on
in
our
city.
That
calls
for
a
bold,
compassionate
and
progressive
action,
and
so
I
hope
for
the
sake
of
Philadelphia's
renters,
especially

sake
of
our
black
printers
that
we
can
deliver
them
a
win
today.

Briana
Westbrook's
and
I'm,
representing
a
Pennsylvania
Apartment
Association
today,
but
out
of
respect
for
your
busy
calendars
and
your
overwhelming
competing
priorities.
I
The
pandemic,
coupled
with
the
events
of
this
past
week,
have
been
particularly
appointment's
and,
on
a
personal
note,
I
can't
even
begin
to
articulate
the
conversations
I've
had
with
fellow
particularly
black
colleagues
and
black
friends
about
I
guess
the
difficulties
that
we're
going
through
right
now
and
what
that
said.
The
leadership
exhibited
by
members
of
this
committee
throughout
all
of
this
should
also
be
commended.
I
Balancing
budget
hearings
or
legislation
that
is
in
front
of
you
today
and
tending
to
the
immediate
needs
of
your
constituents
is
a
huge
and
daunting
task
and
with
the
challenges
that
lie
ahead,
we
believe
continued
dialogue
and
collaboration
is
absolutely
imperative,
and,
with
this
in
mind,
I
am
offering
our
organization's
thoughts
on
these
bills.
But
again
before
we
go
into
policy
analysis,
I
would
like
to
recognize
the
offices
of
councilmembers
Brooks,
God,
EA
and
gam
for
having
a
discussion
this
past
week
about
proposed
amendments
to
this
legislation.
I
We
would
particularly
like
to
thank
the
chair,
this
committee
and
her
staff
for
working
to
have
a
continued
dialogue
that
extended
beyond
the
scheduled
ones.
We
had
in
general
the
organizations
that
make
up
this
group
of
real
estate
organizations
support
the
intent
of
the
package
bills,
which
is
to
assure
that
Philadelphia
is
impacted
by
Cova
19
have
stability
during
an
unprecedented
crisis.
We
believe
that,
through
our
conversations,
we
have
been
able
to
build
consistence
around
important
components
of
this
legislation.
The
definitions
for
certification
of
hardship
and
Kovach
19
financial
hardship
have
been
altered.
I
Although
we
would
like
to
see
a
little
bit
more
requirements
included
with
these
definitions,
we
do
recognize
that
they
are
at
a
more
reasonable
place.
Now.
We
also
acknowledge
that
most
of
the
legislation
now
applies
only
to
philadelphians,
who
are
experiencing
a
Cove,
a
nineteen
belated
heart,
and
we
also
recognize
that
these
changes
are
a
result
of
an
increasingly
collaborative
process,
and
we
do
appreciate
these
amendments.
We
still
have
some
concerns
that
I
will
outline
briefly,
and
we
hope
that
there
will
be
continued
opportunities
to
work
on
them.
I
So,
after
reviewing
these
proposed
amendments,
we
would
like
to
see
the
emergency
order
defined
in
these
bills
more
closely
aligned
with
pre-existing
law.
The
governor
has
an
executive
order
that
places
an
eviction
moratorium
lasting
until
July
10th,
and
we
believe
that
this
date
she
can
remain
consistent
throughout
these
bills.
The
governor's
eviction
moratorium
also
only
applies
to
non-payment
of
rent,
and
we
believe
that
this
same
concept
should
apply
throughout
this
legislative
package,
but
particularly
in
bill
to
zero
zero
to
95,
which
is
the
eviction
moratorium
bill.
I
Also,
we
believe
the
waiving
of
late
fees
should
last
futa
defied
emergency
period,
but
not
any
longer,
which
is
in
reference
to
build
two
zero
zero,
three
zero
two,
and
we
would
also
like
to
see
an
important
change
in
a
payment
plan.
Legislation
as
it
is
currently
written,
a
property
owner,
would
not
have
any
recourse
for
a
resident
who
fails
to
meet
the
requirements
of
an
agreed
payment
plan
until
the
resident
is
four
months
behind.
I
We
think
that's
too
much
time
and
we
think
there
should
be
a
mechanism
to
make
sure
that
both
parties
are
properly
held
accountable
for
upholding
both
ends
of
the
payment
plan.
Agreement,
I
do
have
to
say
we
still
strongly
remain
unified
in
our
opposition
to
bill
two
zero
zero,
three
zero
one
which
would
impact
rent
stabilization
in
Philadelphia
the
impacts
of
rent
controls,
such
as
the
provisions
in
this
legislation
we
believe,
have
been
well
studied
and
documented.
I
They
lead
to
higher
rents
in
the
long
term,
devalue
property,
Stinney
development
of
new
housing
supply,
and
it
also
could
lead
to
less
investment
in
housing,
upkeep
and
updates,
which
is
really
important
in
Philadelphia.
Considering
our
housing
stock
is
considerably
older
in
comparison
to
other
cities.
The
amendments
to
this
legislation
that
funding
me
today
are
a
result
of
a
constructive
dialogue.

As
Rasheeda
said,
their
best
tenant
is
the
one
they
have
and
we
are
committed
to
working
with
you
to
keep
people
in
their
homes
and,
through
this
budget
process,
get
the
money
necessary
so
that
we
can
help
people
stay
in
their
homes
and
then
that
way
we
will
help
renters
and
landlords.
I
have
a
question
for
Rasheeda
I'm
glad
to
hear
you're
coming
back
in
the
10,000
emails
that
I
got
I
found
yours,
so
I
appreciate
it.
So
much
and
I'm
glad
you're
coming
back
to
CLS
to
do
some
work
with
us.

One
of
my
concerns
with
all
of
this
has
always
been
the
course
and
you've
done
so
much
work
with
the
courts.
What
and
what?
If
any
indications
are
you
getting
we're
all
concerned
about
the
courts,
and
one
of
the
things
that
worked
with
the
mortgage
foreclosure
program
was
that
we
had
judge
Rizzo,
who
was
personally
invested
and
Beausoleil
committed.
What
are
the
one
or
two
or
three
things?
We
need
to
ask
the
courts
to
make
sure
the
disillusion
program
could
work
for
the
lessons
we
learn
for
mortgage
foreclosure
from
your
lane.

Obviously,
we
are
in
really
difficult
times
as
already
been
laid
out,
but
I
want
to
touch
on
it
again.
This
city,
before
covet
19,
had
already
been
suffering
a
25%
poverty
rate.
As
many
of
you
know,
we've
already
were
one
of
the
fourth
leading
places
with
terms
of
renting.
We
are
ready,
we're
experiencing
a
great
deal
of
unemployment,
some
of
the
sections
in
Philadelphia
or
experiencing
50
%
unemployment
rates
and
60%
poverty
rates.

We
are
already
were
experiencing
so
much
pain
as
a
city,
one
of
the
highest
incarceration
rates
in
the
country,
40%
of
our
children.
Studies
have
shown
go
to
bed
hungry
every
night.
There's
sections
in
the
city
of
Philadelphia,
where
30
to
40%
of
our
children
have
asthma
and
into
an
event
all
of
those
difficulties
and
also
I
should
say
we
are
one
of
the
fastest
gentrifying
cities
in
the
country.

We
recognize
that
we
are
almost
experiencing
something
completely
unprecedented
on
someone
described
it
as
the
the
1918
pandemic,
plus
the
1929
depression,
plus
the
1968
protests
and
riots
after
King's
death.
We
experienced
all
of
them.
At
the
same
time.
Also
in
these
unprecedented
times,
you
cannot
do
business
as
you
these
unprecedented
times,
where
over
1
in
3
Pennsylvanians
have
actually
filed
for
unemployment
and,
as
our
unemployment
rate
is
skyrocketing,
because
of
it
where
some
of
our
unions
in
our
city,
almost
a
hundred
percent
of
the
union
members,
are
not
working.

We
are
in
incredible
times
and
the
goal
across
West
Philadelphia
in
the
last
couple
of
days
after
the
riding
in
the
looting
that
occurred
in
the
look
at
the
52nd
Street
corridor
and
to
look
at
the
Parkside
shock
riot
in
the
Parkside
lows
and
and
what
happened
on
22nd
Street
in
other
places
in
our
town,
we
are
in
incredible,
see
severe
times
our
schools
are
closed.
They
are
not
only
just
schools
but
they're
rec
centers
they're
community
centers.

No,
no
none
of
the
institutions
that
we
know
us
important
here
is
one
place
that
we
can
say
we
can
keep
this
state.
In
fact,
though,
the
orders
that
have
been
placed
for
for
the
last
couple
months
told
us
to
do
this.
Like
everyone
has
this,
it
would
say:
stay
at
home,
not
everybody
has
a
home
and
right
now.
If
we
don't
do
something,
many
people
will
lose
their
very
place
that
we've
been
telling
them
to
stay
for
the
next
couple
of
months.
So
I.

Really
want
to
say
I
would
encourage
you
to
find
ways
I'm
good,
to
hear
that
the
real
estate
associations
are
agreeing
now
on
for
these
bills,
I'm
glad
to
hear
that
I.
Don't
believe
that
the
other
bill,
rekha
destabilization
rate,
rent
stabilization,
is
something
that
you
cannot
find
agreement
on
in
the
short
term.
We
only
talking
about
a
couple
of
months.
You
know
we're
not
talking
about
stabilization
for
the
next
two
three
five
years.

should
be
able
to
find
some
kind
of
agreement
on
that
and
the
fact
that
a
diversion
program
has
not
been
created.
Look
you're
in
an
emergency,
you're
gonna
be
creating
new
stuff.
You
not
gonna,
know
all
the
stuff.
You
need
to
create
all
right,
so
just
go
ahead
and
do
it
and
figure
it
out
as
you're
going
forward,
because
we
need
leadership
now
to
move
forward
to
stabilize
the
one
place
you
can
stabilize,
and
that
is
the
homes
of
the
people
and
the
children
of
our
community.

just
say

I'm
really
humbled
by
the
opportunity
to
speak
to
you
again
today

just
to
recap:

I
do
reside
in
the
third
District.
My
son
and
I
share
a
humble
studio
apartment
in
46
in
Chester,
one
of
the
perks
of
our
apartment
is
free,
cardio,
it's
a
fourth
floor
walk-up
and
my
first.

It's
really
important
and
I
like
that
they're
all
group
together
I
think
it
makes
good
sense,
I'm
extremely
concerned
that
the
relevance
and
the
importance
of
these
bills
will
be
downplayed,
and
you
know
what
we
can
no
longer
downplay
the
realities
and
and
I
personally
am
really
tired
of
normalizing.
The
abnormal
like,
and
this
overtime
is
detrimental
to
my
health.
My
financial
health,
my
family
health
and
you
know
paying
rent
seems
like
such
a
perfectly
normal
thing
to
do,
but
it
becomes
like
a
Herculean
task.

How
do
I
address
the
deficit
when
what
I
got
versus
what
I
need
to
pay
are
nowhere
near
each
other
and
I'm
not
sure
really
quickly
about
these
two
million
jobs
that
I
read
about
this
morning,
but
my
job
wasn't
one
of
them:
two
million
that
they're,
including
and
saying
we
have
now
and
last
week,
I
told
my
story
here,
but
to
remind
you.
I
do
currently
face
eviction
and
it
is
because
of
the
COBIT
emergency.

It
would
be
so
good
if
the
landlords
would
listen
to
the
tenants
and
create
a
win-win
situation.
We
really
need
the
eviction
diversion
program.
For
the
same
reason,
we
need
to
help
people
get
back
and
like
catch
up
to
themselves.
Now
we're
talking
about
the
money
clock
is
ticking
and
as
an
update
in
my
own
effort
to
be
proactive
at
a
time
when
really
the
only
constant
we
have
is
change
in
upheaval,
I've
scheduled
a
direct
deposit
to
my
landlord
for
my
accountant
and
I
also
have
an
additional
money
order.

any

this
is

heard
the
all

make
sure
that
it
is
clear
about
any
kind
of
moratorium
ending,
but
we're
also
very
clear
that
we're
probably
not
prepared
as
a
city
as
a
health
matter
to
be
able
to
see
so
many
evictions
go
through
court.
So
the
eviction
moratorium
has
a
hard
stop
of
August
31st
2020.
It
will
not
continue
beyond
that.
We've
also
made
significant
adjustments
to
the
to
the
diversion
program.
It
is
now
time
limited.
Instead
of
45
days,
it's
been
reduced
down
now
to
30
days.

It
will
go
hand-in-hand
with
the
payment
and
with
the
installment
payment
plan
so
that
those
two
will
run
concurrent
with
one
another
and
they
will
not
be
seen
as
like
following
one
another
or
causing
any
additional
delays
that
haunt
people,
most
importantly,
I-
think
it's.
It
needs
to
be
clear
that
the
diversion
law
will
be
conditional
on
the
program
being
set
up
and
fully
funded
by
the
city
of
Philadelphia.

This
law
will
only
go
into
effect
if
the
city
has
established
and
funded
the
program,
and
right
now
we
are
working
together
with
more
than
almost
two
dozen
individuals
who
are
working
together
on
a
diversion
program,
working
group
that
includes,
as
you
heard
last
week,
certainly
members
from
judge
Rizzo
to
members
of
the
court
to
are
a
number
of
folks
from
the
landlord
industry
associations,
as
well
as
our
legal
actors
and
advocates.

programs

don't
exist,

diversion
law
is
only
an
effect.
If
the
program
is
actually
in
existence
and
funded
by
the
city,
so
I
hope
that
clarifies
things

my
colleagues
and
I
also
just
want
to
express
my
gratitude
to
colleagues,
especially
to
you
know,
to
members
council,
members,
schoola
and
Gilmore
Richardson
and
communi
Sanchez
had
a
lot
to
do
with
ensuring
that
there
was
clarity
and
responsibility
around
all
of
these
bills.

One
stabilization
bill
to
six
months,
and
there
are
few
other
amendments
that
I
would
like
to
talk
about
both
relation
bill
and
the
late
waiver
originally
applied
to
all
tenants,
and
they
now
only
apply
to
renters
with
the
Kovach
19
related
financial
hardship
and
stabilization
bill
originally
lasted
for
one
year
after
the
Kovach
19
emergency
period,
and
it
now
has
been
shortened
to
six
months.
Like
I
said
fire
and
after
discussions
with
the
affordable
housing
providers,
PHA
subsidized
housing
is
now
exempt
from
rent
stabilization
because
those
residences
have
already
been
subject
to
strict
rate
regulations.

just
want
to

my

me
process
this

is

piece
of
legislation
is

through
