Description
Description
A
A
E
A
E
E
A
C
Is
a
quasi-judicial
proceeding
where
the
Heritage
Preservation
Board
accident,
quasi-judicial,
rather
than
a
legislative
capacity
at
a
quasi-judicial
hearing?
It
is
not
the
board's
function
to
make
law,
but
rather
to
apply
law
that
has
already
been
established
in
a
quasi
judicial
hearing.
The
board
is
required
by
law
to
make
findings
of
fact,
based
upon
the
evidence
presented
at
the
hearing
and
apply
those
findings
of
fact
to
previously
established
criteria
contain
in
the
Code
of
Ordinances
in
order
to
make
a
legal
decision
regarding
the
application
before
it.
C
Anyone
that
is
gonna
be
speaking
tonight?
Do
you
think
you
may
speak?
If
you
could?
Please
stand
raise
your
right
hand
to
be
sworn
in
any
applicants
or
anyone
that
you
think
he
may
speak
yeah
you
do
you
swear
affirm
the
testimony
about
to
give
is
the
truth,
the
whole
truth
and
nothing
about
the
truth,
so
swung.
A
C
Any
members
or
any
applicants
tonight,
because
there
is
not
a
full
board-
the
boards
in
system
five,
we
do
have
a
quorum
because
we
have
four
members.
However,
you
will
need
three
affirmative
votes
to
pass,
so
if
any
applicant
wishes
before
their
application
to
continue
it
to
another
hearing,
they
may
do
so.
Otherwise
they
will
just
proceed.
G
C
D
Yes,
this
is
a
request
to
place
a
new
fence
on
a
contributing
property
at
3
or
4
West
Lime
Street.
This
is
a
Colonial
Revival
structure
of
brick
according
to
the
master
site
file,
it's
the
property,
surrounded
by
an
existing
concrete
block
sight
wall
and
the
applicant
proposes
to
add
a
wood
fence
behind
the
sight
wall
along
the
northern
and
eastern
property
lines.
D
The
wood
structure
will
not
be
attached
to
the
block
wall
but
supported
by
posts.
The
fence
will
run
the
length
of
the
rear
or
north-north
property
line,
that's
under
than
15
feet,
and
it
will
run
along
the
east
property
line
at
Shattuck
Street
along
that
side.
For
about
72
feet
and
the
fold,
wood
fence
will
be
connected
to
the
residence
on
both
the
east
and
west
sides
to
enclose
the
rear
and
side
yard
in
that
area.
D
The
master
site
file
describes
a
concrete
block
sight
wall
with
brick,
piers
and
a
metal
rail
which
you
can
see
in
some
of
the
photographs
that
were
provided.
The
applicants
desire
is
to
enclose
that
rear
yard
and
shield
it
from
view,
especially
from
the
back
I
believe
and
the
applicant
is
here
and
can
talk
to
that.
That's
understandable
the
applicant
does
not
want
to
disturb
the
block
wall,
try
to
build
on
it
or
attach
something
to
it.
So
this
was
the
proposal
that
is
before
you
tonight.
D
With
respect
to
the
fence
design,
the
applicant
proposes
a
board
on
board
horizontal
design.
We
using
six
inch
boards
spaced
about
eight
feet
apart
and
the
wood
material.
As
far
as
that
aspect
of
the
guidelines
is
not
something
that
is
used
on
the
property
on
this
under
principle,
structure
or
the
wall,
so
it
would
be
a
different
type
of
material.
That's
being
proposed.
The
fence
technically
would
meet
the
standards
of
the
land
development
code.
D
This
application
was
noticed
and
there
were
no
responses
received
and
staff
is
recommending
that
the
applicant
present
his
project
and
that
you
discuss
it.
We
feel
that
there
could
be
something
accommodated
along
that
back
line
property
line.
Perhaps
we
feel
that
the
Shattuck
side
just
the
difference
in
materials
with
the
fence,
it
would
be
offensive
to
materials
and
the
fact
that
the
proposed
wood
material
is
not
consistent
with
the
rest
of
the
property
makes
the
Shattuck
street
side
difficult
to
to
accommodate.
H
Someone
behind
houses
to
be
to
garage,
he
started
building
meeting
a
house
there
and
same
like
we.
We
are
normal.
Having
progress
in
there
and
I
think
should
be
no
issue
to
build
fence
there,
but
the
side
side
side,
the
shadow
straight,
the
idea
we
have
it
just
to
have
some
privacy
in
back
and
go
to
basically
almost
four
feet
and
30
inch
high
above
the
wall
and
the
fans.
Would
the
the
broad
and
broad
horizontal
fence
will
be
no
attached
in
the
wall.
H
We're
gonna
have
the
4x4
poles
digging
the
hole
in
the
wall
and
ground
and
having
the
fence
original
attached
to
the
wall
and
going
basically
from
the
top
of
the
wall
up
down.
So
basically
from
from
the
back,
like
you
see
in
a
picture
we
just
have
today,
we
just
build
sample
there
and
a
post
there.
It's
not
the
real
one,
the
high
just
to
have
an
idea
how
I'm
gonna
be
gonna,
look
like
to
have
soo
easy
from
the
back
from
shadows
from
the
and
the
year
from
the
Shadwick
Street.
H
You
will
see
the
middle
from
outside
go
into
the
wall,
the
war
they
exist.
There
and
the
fence
would
be
basically
in
top
of,
and
we
know
attached
to
the
wall
so
from
my
opinion
and
it's
not
gonna
twin
match,
I
guess
the
Korean
style
from
the
house
and
the
wood
material.
We
chose
I
think
it's
it's
kind
of
from
color.
How
we
are.
We
are
gun
at
me
and
we
are
not
gonna
use
any
color
and
we
just
silly
to
have
match
the
house
and.
F
H
We're
gonna
have
the
fence,
basically
no
director
a
little
bit
a
couple
inches
far
from
the
wall.
To
have
this
corner
there
going
all
the
way
straight,
so
we
don't
have
to
be
close
to
the
wall.
I
mean
if
the
only
issue
there
we
are
flexible.
We
can
work
something
else,
but
the
idea
was
just
to
go
in
a
couple
inches
over
the
wall,
so
we
can
have
everything
in
one
line.
H
A
H
Are
in
front
sight
of
the
house,
yeah
I
mean
that
I
was
talking
to
mrs.
pett.
If
isn't,
big
issue
will
be
too
good.
Holster
aside
by
shadow
street,
we
can
just
go
from
like
I
said
just
from
the
corner
of
the
house,
which
is
36.5
feet
from
the
front
side
to
the
house.
We
can
ignore
the
one
we
don't
have
to
be
defense
for
the
side
there,
if
isn't
being
an
issue,
so
we
can
just
go
from
there
to
the
end
of
the
to
the
back
of
the
house.
If
there's.
A
F
H
A
D
So
just
to
kind
of
clarify
and
we've
accepted,
you
know
that
the
guidelines
do
specifically
talk
about
board
on
board,
bore
like
some
of
the
more
like
wood
structures
and
that
as
something
that
breaks
up
the
plane.
Usually
those
are
vertical
board
on
board
this
one's
a
horizontal,
I
guess
the
question
I
would
ask
you
is:
are
you
thinking
if
he
broke
up
that
pattern
say
he
did
something
different
every
every
every
few
feet
or
something
that
it
might
be
more
accepted?
D
Well
that
that's
I'm
not
sure
he
understands
what
you're
asking
as
far
as
breaking
the
pattern
up
we've
had
people
with
vinyl
fences
do
vinyl
for
a
while,
then
the
lattice
panels,
for
you
know
as
an
accent
to
break
it
up.
We've
had
people
put
things
on
the
fence.
We've
had
you
know
people
do
sometimes
cutouts
in
so
I
guess.
The
question
is:
if,
if
would
you
be
amenable
to
breaking
up
just
expanse
of
this
design
board
on
board
every
so
often
with
some
sort
of
pattern,.
F
D
E
And
I
have
a
question
when
you
look
at
the
design
review,
guide,
number
four
and
number
7
and
number
four
reads
this:
the
use
of
multiple
fencing
materials
and
styles
creates
a
a
piecemeal
of
fact
which
detracts
from
the
character
of
the
house
and
district,
and
it
is
prohibited.
But
when
you
read
number
seven,
it
says:
chain-link
fencing,
which
is
non
historical
fence
type,
is
not
recommended.
However,
vinyl
created
chain-link
in
combination
with
landscaping
can
be
compatible.
H
H
No
I'm,
just
thinking
yeah
I've,
been
there's
been
option
two
and
just
like
I
said
divine
I,
think
I,
don't
think
the
vinyl
will
have
I
mean
they
will
affect
the
character
of
the
house
of
the
looking
of
the
house.
My
opinion
is
because
the
vinyl
you
see
no
everywhere
any
house,
any
modern
house,
any
different
design
different
acting.
They
have
this
most
I
use
vinyl
one
and
this
colony,
a
style,
I
think
kind
of
food.
Much
me
and
we
give
more
character
to
the
house.
I
know.
G
I
G
A
A
G
G
I
G
A
F
A
I
H
D
So
man
may
I
ask
the
board
a
couple
questions.
First,
as
far
as
the
back
wall,
yet
do
the
board
members
make
a
distinction
between
the
the
back
and
and
the
Shattuck
Street
side,
and
if
so,
would
the
do?
You
feel
that
what
would
be
acceptable
would
be
different
for
each
of
those
and
I
guess.
What
I
want
to
find
out
is
is
this
proposal
as
it
stands
tonight?
D
E
G
The
part
that
has
me
concerned
is
the
one
on
Shattuck
give
it
back.
You
know,
I
have
no
problem
with
your
design
on
that,
but
when
you're
facing
the
street
and
the
house
they're
really
really
nice
and
I
have
an
high
fence,
particularly
going
to
the
front
of
the
house.
It's
gonna
take
a
lot
away
from
that
out
know
if
you
back
the
fence
up
or
do
a
redesign
on
that
side.
Somehow,
where
you
keep
the
character
of
the
brick
fenced
by
the
road
and
still
show
off
the
house.
A
A
A
H
H
C
A
D
Seaboard
shall
maker,
if
you
deny
an
application,
or
in
this
case
I
guess
a
partial
application.
If
you
do
go,
that
route
board
shall
make
recommendations
to
the
applicant
concerning
changes.
If
any
that
would
cause
the
board
to
reconsider
denial
and
shall
attempt
to
resolve
the
differences.
Applicant
may
amend
an
application
in
order
to
provide
for
the
recommendations
of
the
board,
so
that
makes
it
sound
like
they
could
actually
vote
on
a
denial
state
reasons,
and
then
the
applicant
could
amend
it.
The
same
application.
A
J
D
H
Okay,
then,
then,
would
be
okay
if
we
can
forget
approach
for
the
back
wall
to
build
this
kind
of
fence
just
for
the
back
part
of
the
application
and
right
there
sorry
site
of
shadow
strike.
Maybe
we
we
thanks
something
else
or
maybe
we'll
go
with
the
plant
to
find
easy
way
to
to
have
the
soft.
We
can't
really
just
get
approval
for
I
mean
you
guys
so.
C
What
could
happen
and
I'm
not
saying
it?
Well,
what
could
happen
is
you
can?
The
applicant
is
asking
for
the
fence
around
his
property,
so
if
you
only
allow
it
on
the
back
fence
you're
effectively
denying
his
application
for
the
other
part,
so
he
will
be
allowed
to
build
whatever
you
say
he
can
build
and
he
cannot
build
anything
else
you
would
have
to.
You
have
to
come
back
if
you
so
choose
all.
D
A
F
I
C
C
D
D
With
respect
to
the
analysis,
the
driveway
will
be
placed
on
the
north
side.
It's
basically
a
minimal
driveway,
starting
at
10
feet
wide
at
the
pro
at
the
right-of-way
line,
narrowing
to
six
point
seven
feet:
other
driveways
on
this
block
in
this
area
of
North
Korea,
seven,
who
are
generally
a
narrow,
concrete
or
paver
construction
driveways
and
the
applicant
is
proposing
the
brick
style
paper
for
the
driveway.
D
The
property
already
has
an
existing
sidewalk
consisting
of
brick
or
brick
style,
pavers,
I'm,
not
sure
I
didn't
walk
on
it
to
see
if
it
was
actual
brick.
But
the
applicant
is
here
the
driveways
alone.
Again,
this
area
of
gross
Avenue
have
both
materials
concrete
and
paper,
and
their
driveway
as
proposed
does
not
detract
from
this
contributing
property
or
the
neighborhood.
It
conforms
with
the
land
development
code
and
is
consistent
with
the
Comprehensive
Plan
and
it
seems
to
be
preferable
to
driving
and
parking
on
the
grass,
which
is
what
the
applicant
is
doing
now.
D
A
A
A
A
B
A
D
D
With
respect
to
the
district,
going
to
page
three
of
the
staff
report,
the
for
the
analysis
of
the
signs,
the
freestanding
to
be
a
hanging
sign,
supported
by
a
post
of
about
five
feet
in
height
placed
in
the
front
yard
and
to
be
of
wood,
construction
and
the
applicants
also
proposing
one
aluminum
wall
sign
to
be
placed
over
the
port
entrance.
Porch
entrance
and
one
non-illuminated
cabinet
sign
to
be
placed
on
the
south
side
of
the
building
and
that
sign
will
be
aluminum
with
a
vinyl
face.
D
The
signs
seem
to
be
professional,
looking
and
understated
and
consistent
with
a
historic
district.
All
the
signs
appear
to
conform
to
the
land
development
code
and
consistent
with
the
Comprehensive,
Plan
and
staff
is
recommending
approval
of
this
request
to
placed
three
new
signs
on
the
property,
and
this
application
was
properly
noticed
and
there
were
no
comments
received.
A
A
L
But
I
too
was
confused
because
we
did
a
pretty
extensive
renovation
that
didn't
have
to
come
to
you
guys,
and
then
we
got
to
the
sign
port
of
a
part
of
it
and
I'm,
not
a
sign
guy
I
own.
The
property
and
I
also
work
in
the
property,
and
we
had
a
sign
subcontractor
that
didn't
understand
this
process,
and
so
that's
why
I'm
here
as
the
owner
to
make
sure
that
it
happens.
