in
the
highway
business
district,
it's
being
requested
by
the
gatherings
with
Jesus
Inc,
which
is
currently
located
in
the
same
plaza
where
the
daycare
will
be
located
and
the
owner
is
new
error.

what's
happened
with
going
on
in
this
particular
plaza.
Is
the
area
around?
It
is
a
mix
of
uses,
yet
most
of
them
are
commercial
uses.
The
residential
uses
that
we
do
have
here
are
actually
in
the
mobile
home
park,
that
is,
to
the
rear
of
this
property
and
actually
to
the
adjacent
property
as
well.
That
is
residential
uses,
but
mobile
home
parks
are
also
classified
as
a
commercial
type
of
use.
A
That
being
the
case,
the
area
is
all
commercial
in
this
particular
land
use
allows
for
daycare
facilities
only
by
a
conditional-use
request,
so
the
applicant
has
making
that
partition
to
this
board
tonight.
The
existing
church
is
in
the
front
part
of
the
plaza,
and
this
actually
would
be
in
the
rear
part
of
the
plaza,
where
there's
actually
an
open
area
that
allow
for
them
to
develop
a
play
area
in
the
corner
of
the
lot.
That
being
the
case,
what's
what's
going
on
in
the
surrounding
areas?

have
a
paint
store
in
the
plaza
you
have
dog
lovers,
ultimate,
which
is
a
retail
there's,
other
retail
businesses
there
and
then
adjacently
is
roadhouse.
The
one
issue
that
we
look
at
really
for
conditional
uses
and
compatibility
in
in
the
highway
business
district
or
any
commercial
district
is
their
proximity
to
businesses
that
serve
alcohol
and
also
their
proximity
to
adult
businesses.
In
this
particular
case,
daycare
facilities
are
specifically
exempted
under
our
code
for
the
alcoholic
beverage
provisions.
They
are
allowed
adjacent
to
an
alcoholic,
any
business.
A
It's
not
an
alcoholic
beverage
license
in
this
particular
case.
That
would
be
the
codis
roadhouse,
that's
adjacent
to
the
overall
plaza,
however,
from
codys
door.
It
is
more
than
200
feet
to
this
business,
so
they
were
they
more
than
consistent
with
our
alcoholic
beverage
requirements,
even
though
they
don't
have
to
meet
them.
There
are
no
adult
businesses
within
a
thousand
feet
of
this
proper
of
this
project,
so
being
that
the
project
is
consistent,
incompatible
with
that
highway
business
district-
that
is
in
this
particular
in
this
particular
neighborhood.

are
no
issues
really
with
the
other
uses
that
are
around
it
in
it
not
being
compatible
with
them
and
based
on
that,
the
fact
that
the
plaza
is
already
developed,
there's
there's
plenty
of
parking
there.
They
do
have
the
availability
of
open
space
to
allow
for
a
fence
playground
which
is
actually
part
of
your
packet.
There's
two
smaller
maps
in
your
packet.

is
the
actual
floor
plan
for
the
daycare
facility
that
they're
planning
on
they're
planning
on
utilizing
and
the
other
is
the
playground
area
that
they're
planning
for
to
allow
for
open
space
play
for
the
children
that
will
be
going
to
this
facility.
There
will
be
no
with
this
in
this
particular
use.
There
is
no
ink,
it's
very
compatible,
it's
their
son,
it's
very
compatible
with
the
surrounding
neighborhood.
There
is
no
conflict
with
the
goals,
objectives
and
policies
of
our
comprehensive
plan.

conditional
use
is
occurring
on
the
development
site,
there's
no
environmental
or
historical
resources
that
will
be
impacted
here.
There's
no
adverse
impact
to
adjoining
property
values
that
are
anticipated
with
this
particular
conditional
use
being
approved
and
there's
no
changes
to
the
level
of
service
to
be
required
for
this
particular
proposed
use.
So
with
that
staff
is
satisfied
that
the
applicant
has
demonstrated
that
the
use
is
compatible
with
the
surrounding
area
and
there's
actually
two
conditions
that
staff
would
like
to
propose.

is
that
the
outdoor
player
must
be
fenced
and
supervised
at
all
times
by
staff.
Members
of
the
daycare
facility
into
a
building
permit
or
approval
from
the
city
building
department
must
be
obtained
for
any
changes
or
alterations
made
to
the
building.
These
are
pretty
standard
conditions,
obviously
want
the
kids
to
be
supervised,
that
they're
going
to
be
in
an
outdoor
play
area,
and
they
already
have
it
showing
that
it's
fenced
so,
including
defense.
It's
already
shown
on
the
site
plan
that
we
have
and
any
changes
the
building.

this
property,
however,

facility
that

completely
self-contained

the
only
time
these
kids
are
going

outside
is
in

it

close

anything
in
our
guidelines
that
have
anything
to
do
with
the
daycare
being
that
close
to
residential,

is
probably
because
that
has
outside
kennels

have
outside
areas
where
they
allow

dogs
to
go
out

to

and
they're
going
to
bark
yeah
you're
going
to
have
some
overflow
with
kids

noise,
but
it's
a
different
type
of
noise.

if
the
kids
become
rowdy
they're
going
to
take
them
inside.

know
a
lot
of
times
when
you're
dealing
with
doggie
daycare.
They
have
a
certain
amount
of
time
that
they
have
to
spend
outside.

think
you're

to
have
the
same
type
of
situation
here,
as
you
would

doggie
daycare,
mostly
because
the
folks
are
going
to
have
to
supervise
children

lot
more
than
you
do
supervised
dogs,

in
a
you,
know
enclosed
area,
people
don't
think
about
them.

often
they
just
you

put
them
out

defense

we're
going

put
up
as

six-foot-high
vinyl
fence
that
goes
the
complete
perimeter
of
the
of
the
playground
with
a
security
door
with
key
card
access
to
get
actually
getting
in

that
playground
from

outside
the
security
inside
the
building
to
be
cameras
in
each
classroom
and
down
the
hallway.
There
will
be
key
card
access
from
the
front
lobby
area
into
the
classroom
area.
They'll
protect
the
kids
well.

other
thing
I
just
like
to
mention
regarding
the
residential
area
directly
behind
this
Plaza
is
an
industrial
parking
and
the
residential
areas
are
behind
that
industrial
park
and
behind
reload.
So
it's
quite
a
distance
away
and
we'll
probably
have
a
maximum
of
probably
seven
or
eight
two
to
three
year
olds
in
the
playground
at
any
one
time.

we
need
to
look
at
where
we're
really
putting
them
there

They
have
a
right
to
have
it,
but
they
have
the
industrial
behind
them
and
the
businesses
on
either
side

think
in
the
future.

zoning
about
daycare
centers
and
where
they
can
go
and
maybe
strengthen
the
conditions
for
them

little
bit
more
and
that's
just
for
a
safety

parents
