owners

that

We
submitted
an
application
for
rental
housing
demolition
for
this
property.
Whole
purpose
of
this
is
this
actually
goes
back
to
rectifying
previous
order
to
comply
with
respect
to
apartment,
built
apartment
units
that
were
constructed
without
the
appropriate
building
permits.

Since
the
order
to
comply
was
issued
in
2017,
we
have
worked
with
staff
in
order
to
bring
these
units
into
compliance
with
the
Ontario
Building
Code
and
to
address
all
concerns
with
respect
to
the
building
code,
as
well
as
the
Ontario
fire
code.
We
have
as
a
result
of
the
Building
Code
and
the
requirements
we
had
to
reduce
number
of
units
to
just
a
total
of
five
units
from
$6
occupied.
As
a
result
of
that,
we
were
required
to
submit
this
application
to
demolish
rent
demolish
the
rental
units.

had
previously
submitted
a
minor
variants
application
to
the
community
adjustment,
which
was
approved
under
condition
that
the
owners
enter
an
agreement
with
respect
to
the
rental
housing
demolition.
The
owners
have
agreed
to
all
the
terms
that
have
been
provided
by
city
staff
and
are
more
than
happy
to
provide
the
appropriate
compensation,
as
well
as
any
associated
moving
cost
and
the
right
to
return
for
all
tenants
back
into
the
building.

of
a
fire

comment
on
the
protections
in
place
for

future
road

run
from
Eva
Road
up

try

accommodate
all
road
users,
not

vehicles

movements,

curriculum
users,
but
if
there's
an
inherent
safety
issue,

that's
something
that
we
are
really
cognizant
of
and
we
will
certainly
rectify
the
situation
with
appropriate
mitigating
measures.

Summit
industrial
income,

we
are
the
owners
of
the
property
at
330
Humber
line
and
I'm
here,

provide

speak

support
of
our
application
to
remove
a
city-owned
three
adjacent
to
our
property,
and
we
are.
We
have
been
undertaking
work
to
implement
substantial
building
improvements
to
an
industrial
facility.
There
I
it's
to
sustainably
revitalize
an
existing
building
asset
and
to
secure
a
new
tenant
for
space
that
has
been
vacant
for
a
number
of
years.

Our
objectives
have
been
to
add
value
to
the
neighborhood.
Add
new
employment,
improve
existing
asset,
aesthetic
and
quality,
uses
sustainable
design
approach
and
provide
safe
and
functional
operations.
Over
the
span
of
the
last
two
years,
we've
been
carrying
out
the
work
of
realizing
this
improvement
project.
We
applied
for
and
successfully
obtained
committee
of
adjustment,
requisite
building
permits,
private
treatment,
posted
all
securities
and
paid
all
fees
and
work
collaboratively
with
all
city
departments.

As
you
can
see
from
the
urban
forestry
staff
report,
we
have
been
denied
a
permit
for
the
removal
of
a
city-owned
tree,
Huddersfield
Road
and
are
therefore
finally
stymied
actually
in
achieving
our
objectives
and
hence
appealing
the
decision.
All
the
work
has
been
physically
completed
that
has
been
permitted
as
you'll
see
in
the
photograph.
In
my
submission,
it
identifies
the
one
city-owned
tree
on
Huddersfield
road
that
we're
seeking
to
have
permission
to
remove
to
allow
safe
and
functional
truck
movements.

The
driveway
was
located
given
the
constraints
on
the
site,
to
avoid
the
existing
transformer
to
be
far
enough
away
from
the
intersection
to
provide
safe
movements
and
not
to
conflict
with
street
traffic.
Also,
as
you
can
see
of
my
submission,
there's
a
photo
of
the
facility
prior
to
the
improvements.
It's
really
it
was
in
unfavorable
status.
It
had
been
vacant
for
multiple
years.
The
landscaping
was
in
fact
in
poor
condition.

There
were
no
loading
spaces,
no
public,
sidewalk
pedestrian
connection,
so
we're
quite
proud
of
the
new
plan
that
we
developed
jointly
with
staff,
and
it
is
going
to
implement
94
new
trees
that
are
being
planted
on
the
site.
In
addition
to
the
loading
spaces,
hardscape
amenity
area
and
a
new
public
sidewalk
pedestrian
connection
in
stormwater
recycling
for
the
irrigation,
we
made
numerous
concessions.

to
respect
those,
so
we
deleted
up
by
north-south
Drive
Isle
that
was
intended
to
connect
to
our
existing
Humber
Line
driveway
and
replaced
it
with
landscaping
deleted.
One
loading
space
deleted
the
fencing
that
was
intended,
sculpted
the
berms
and
and
paid
great
attention
to
the
aesthetics
of
the
property,
so
we're
seeking
a
successful
outcome
for
all
parties.
The
subject
tree
is
in
a
high-traffic
area
for
trucks
and
service
vehicles
using
the
existing
driveway.
The
removal
of
the
tree
and
planting
replacements,
or
cash
in
lieu
will
result
in
a
net
gain
of
the
city's
tree.

Respectfully,
we
do
submit
that
multiple
concessions,
voluntary
improvements,
substantial
property
investment
we've
already
implemented-
should
have
a
positive
bearing
on
our
request
and
we
still
remain
a
mountable
to
providing
the
remedies
and
offsets,
as
stipulated
in
the
urban
forestry
staff
report.
So
we
think
the
Community
Council
for
considering
our
matter
the
content
we
put
forward
and
and
are
seeking
the
beneficial
outcome
that
we've
indicated.

quite
closely
on
this
for
a
number

months
trying

find

good
outcome

nonetheless
we
are
a
community
council
with
staffs
recommendation
to
deny
the
tree
removal
I
mean
having
said
that,
so
have
you
considered
any
other
way
or
any
other
alternative
plans
to
keep
that
tree
in
place
and
to
meet
your
objectives
of
the
revitalization
in
occupying
the
vacant?

plans

opportunities

seeing

we
might
be
able
to

do
on
the
site.

we
work
very
closely
with
urban
planning
staff

provided
early
access

all

plans

adjustments
to
to
where
we
could
some
of
the
areas
that
we
really
respected
staff
requests.

The
preference,
certainly
by
transportation,
is
that
we
enter
onto
a
side
street
not
on
to
Humber
line,
drive
and
add
driveways
there,
and
we
really
felt
that
this
was
a
mitigated
solution
and
with
all
the
trees
that
are
being
planted

indicated.

forestry

offset

removal

would
bring

up

a
seventy
five
net
new
trees,

by
moving
the
motion
to
strike
staff
recommendations
and
if
I
could
be
put
up
on
the
screen.
Just
to
summarize
it
is
to
grant
the
applicant
the
permission
to
remove
one
city-owned
tree
and
in
lieu
of
cash
of
the
validation
link
to
the
value
tree
of
three
thousand
eight
hundred
and
nine
dollars
and
a
replacement
of
five
trees.
I
You
know
and
what
I
want
to
start
off
by
you
know
thinking
of
control
the
work
she's
done
in
you
know
in
the
community
and
in
revitalizing
that
property
and
remember
meeting
with
them

think
about
two
years
ago
about
revitalizing
this
properly

you've
done
good
work.

the
tree
has

people
even
issue

respect
where
staff
are
coming
from.
They

policy

they
have
to
abide

us

conversations
with
the
applicant,

this
may

community
council

see
what

my
colleagues
want
to
do
here,
but
the
reality
is,
will
be
a
very
difficult
thing
to
get
past
downtown.
City
Council,
especially
you
know,
private
trees
are
hard
enough.
City
tree
is
even
harder,
but
I
I'm
supporting
this
is
because
you
know
they're
bringing
new
jobs
to
the
community,
which
we
need.
I

All
of
the
rules
has
followed
all
of
them
benefit
by
creating
an
enhanced
employment
space,
yet
that
bumps
up
in
conflict
with
councils
policy
when
it
comes
to
preserving
trees
and
I,
think
that
we're
going
to
need
to
resolve
that
and
I
appreciate
that
we're
going
through
this
process
right
down.
I
think
this
is
the
right
motion
to
do
that,
but
I
think
in
the
long
run.

City
Council
needs
to
get
this
sorted
out
because
it's
very
difficult
for
an
applicant
to
invest
time,
money
and
effort
into
a
large
project
and
then
only
to
be
held
up
at
the
very
last
minute,
with
a
different
decision
on
a
tree.
Moreover,
I
think
that
public
sentiment
on
this
when
they
look
at
the
conflicting
policies
does
not
enhance
their
faith
in
government.

confuses
people
further
and
I.
Think
if
you
took
a
straw
poll
of
people
out
there
and
I
think
most
people
would
see
the
value
that
you
know.

find
our
way
through

perception

homeowner

home

his
daughter
and
in
the
process

designing
this
home.

of
adjustments
to

able
to
get
monitoring's
approval
for

construction

the
new
home
and
in
doing

trying
to
finalize
our
application
for
a
building
permit.
We
are
not
able
to
get
permission
to
remove
the
two
existing
city
trees
that
are
currently
located
within
the
sloping
part
of
the
site.

applicant
to
build
a
new
home

site

demolish

home

homeowner

these
trees

rebuild
the
house
with
the

impossible
to

anything
on

to
grant
permission
to
remove
the
trees
and

know

gonna
have

difficult
time

to
look
at
a
policy
that
we
have
in
place

city
of

the

home

want

build

housing
and

important

derelict
in
garbage
for

to

up
