The
next
agenda
item

we

is

you

An
exemption
now,
as
you
realize,
bylaws,
are
of
general
application
and
when
asked
for
an
exemption,
there
has
to
be
something
exceptional
that
would
take
it
outside
of
the
normal
operation
of
the
violets.
In
this
case,
this
fence
doesn't
provide
any
exempt
exception
to
the
rule
regarding
the
bylaws
and
I
would
suggest
that
does
the
fact
that
there
are
no
exceptional
characteristics
of
this
fence
that
it
should
be
refused
in
terms
of
the
application
for
an
exemption.

But
I
would
like
to
note
that,
through
the
report
to
the
city
specifies
one
offense
violation,
which
is
a
height
violation.
The
fence
exceeds
two
meters
in
height,
and
that
is
an
obvious,
an
obvious
contravention
of
the
bylaw
that's
relevant
to
fencing,
but
in
my
research
of
the
fence,
I've
identified
no
less
than
11
specific
violations
of
the
relevant
bylaws
that
pertain
to
this
fence.
With
respect
to
the
fence
itself,
there
is
under
the
bylaws
and
I
hope.

You've
had
a
chance
to
review
my
submissions
and,
in
those
I've
specified
the
exact
bylaws,
but
I'm
not
going
to
go
through
them
all,
but
generally,
for
the
sake
of
this
is
summarizing.
Some
of
the
violations
here,
essentially
the
bylaws,
prohibit
fences
that
do
not
comply
with
the
applicable
regulations
of
the
city,
and
this
obviously
doesn't.
Secondly,
you
will
note
that
this
fence
is
constructed
of
sheet
metal
or
corrugated
metal
panels
and
that
material
is
specifically
prohibited
under
the
bylaws.
So,
thirdly,
it
vilas
prohibit
the
erection
of
any
fences.

The
use
materials
are
not
usually
intended
for
use
as
permanent
fencing.
I
would
submit
that
this
corrugated
metal
is
usually
used
for
wheat
silos
or
industrial
locations,
but
it
certainly
is
inappropriate
as
a
fencing
material
and
therefore
that's
a
third
violation
of
the
bylaws.
Now
the
report
to
the
city
has
documented
the
excess
height.
So
that's
the
fourth
violation,
and
you
will
note
that
my
client
here
has
undertaken
to
show
graphically
essentially
how
far
this
exceeds
the
standard
heights
required
under
the
bylaws.

Now
you
will
note
that
this
is
mr.
Vic.
Gatos
he's
got
a
has
a
post
here
and
that
crossmember
is
the
two
meter
maximum
height
for
fences
under
the
bylaws
and
as
we
go
through
these
pictures,
I'm
not
going
to
go
through
them
all,
but
essentially,
as
he
works
his
way
down
the
fence,
you
will
note
how
excessive
is
the
height
of
the
fence,
as
he
goes
towards
the
end
of
the
fence,
and
I
would
like
just
to
remind
you.

This
fence
is
over
30
meters
long,
it's
a
third
of
a
football
field,
and
that
places
it's
an
excess
of
3
meters
high.
So
it
creates
quite
the
barrier
and
I
would
note
that
you
will
note
in
this
particular
picture
the
excess
height.
It
appears
that
the
fence
is
on
a
different
gradient.
Now
that
gradient
as
you'll
see
those
logs
that
underpin
the
fence
is
some
grading
that
has
been
installed
by
the
neighbor
and
strict
contravention
of
the
typical
of
the
applicable
laws
and
I'll
get
to
that
later.

In
terms
of
my
objections
to
the
grading,
but
I
would
assume
that
probably
the
city
inspector,
probably
measured
from
her
side
of
the
fence
and
therefore
we
have
some
minimal
variations
or
excesses
of
height,
measured
from
the
neighbor
side.
But
from
my
clients,
side
you'll
see
that
the
excess
height
is
quite
extraordinary.
The
natural
grade
is
where
you
see
that
stick
is
situated.
The
additional
grade
installed
by
the
neighbor
is
indicated
by
those
logs
and
the
fill
that
is
indicated
in
those
materials.

So
again,
as
mr.
Vega
dos
makes
his
way
down,
you'll
see
those
X's
Heights
aren't
quite
incredible.
The
the
excess
height
varies
quite
wildly
over
the
the
course
of
the
fence,
and
I
would
suggest
that,
on
the
basis
of
stuff
that
excess
height
alone,
the
application
for
an
exemption
should
be
denied.

And
again,
these
other
pictures
probably
merely
indicate
the
further
exit,
the
extreme
excess
height
of
the
offense.
Now,
in
this
last
picture,
I
want
you
to
know
that,
underneath
the
fence,
the
neighbor
has
used
as
grading
materials.
What
appears
to
be
garbage
essentially
there's
pot,
so
that
you
can
identify
in
this
picture
and
there
are
better
pictures
of
further
on,
but
the
grading
of
this
fence
is
a
it's
an
M
substantial
and
it's
also
in
violation
of
the
relevant
bylaws.

Well,
essentially,
what
I
have
here
is
essentially
the
corrugated
steel
itself
is
an
abysmal
eyesore,
which
ought
to
be
disallowed,
given
the
fact
that
it
violates
so
many
various
bylaws.
The
fact
that
it
intersects
trees,
where
she
has
nailed
to
the
trees
fence
post
and
that's
particular
particularly
prohibited
by
the
bylaws,
are
irrelevant
to
tree
protection
and,
most
importantly,
this
whole
area
is
subject
to
protected.
It's
been
identified
as
a
protected
area
under
the
City
of
Toronto.

What
you
don't
know
is,
if
you
have
a
look
at
the
picture,
that
is
the
dwelling
that
our
house
is
beside.
This
is
the
first
bylaw
violation
of
mrs.
sable.
This
is
a
picture
that
we
must
live
beside.
It's
never
been
properly
stuccoed,
as
was
originally
submitted
in
the
building
permit.
At
this
point.
At
other
points
in
this
disables
history,
she's
built
a
completely
separate
dwelling
at
the
property
of
her
home.
So.

You,
okay,
so
that
you
understand
that
there's
a
history
of
complete
a
pattern
by
mrs.
sable,
where
she
does
whatever
she
wants
when
she
wants
without
consideration
to
city
bylaws
or
those
around
simply
because
she
wants
to
so
today
is
gonna,
be
our
sixth
time
before
City
Council
to
dispute
this
fence,
obviously
you're
all
overwhelmed,
and
it
is
not
our
desire
to
come
and
fight
over
a
fence.

I
just
want
you
to
know
that
and
we're
tired,
and
we
want
to
put
this
to
rest,
we
realize
that
everybody
is
overstretched
here
and
should
not
have
to
deal
with
these
kind
of
issues.
So
we
really
want
to
get
this
resolved
here
today.
So
I'm
gonna
ask
you
to
put
your
stake
in
the
ground
and
decide
which
side
of
the
fence
are
you
gonna,
be
on
today?
Will
you
be
on
the
side
that
says
blatant
loss?

Scoffing
of
the
law
is
permissible
and
an
attitude
of
it's
not
breaking
the
law
until
you
get
caught
should
be
tolerated
that
anybody
could
build
anything
they
want
just
because
they
want
to
with
no
consideration
for
those
around
them
or
the
law.
Are
you
gonna
be
on
the
side
that
sends
a
clear
message
that
says
those
that
put
themselves
above
the
city
bylaws,
and
it
says
that
violating
bylaws
wasting
people's
time
taxpayers
money
will
not
be
tolerated.
I
want
you
to
imagine
if
everybody
had
a
history
of
like
mrs.
C
able
of
breaking
laws
just
because
they
want
to
building
separate
dwellings
and
astroturf
and
nailing
things
to
trees
and
putting
up
a
corrugated
vent
shoots
by
the
way.
I'll
have
you
note
is
very
dangerous.
If
anybody
is
standing
beside
that
corrugated
fence
and
lightning
hits
it,
they
will
be
instantly
electrocuted.
So
you
need
to
decide
here
today,
because
you
don't
want
that
on
your
conscience,
it's
illegal
to
have
corrugated
steel
and
it's
a
hazard,
so
any
of
our
kids
that
are
playing
in
our
backyard
or
even
mr.
C

This
is
what
we
have
to
live
with,
seeing
the
corrugated
steel
heats
up
and
basically
is
not
good
for
the
plants
that
my
father
keeps
trying
to
plant
every
year,
but
cannot
because
all
that,
whatever
she
used
to
fill
the
thing
that
the
plastics
from
it
looks
like
it
came
from
a
Toronto
landfill
site
keeps
spilling
over
and
destroying
all
the
plants
in
the
gardens,
causing
us
a
substantial
amount
of
money
and
we're
not
happy
with
that
either.
So,
just
another
consideration.

at

so
I
would
just
like
to
go
through
a
couple
of
quick
things.
My
house
wasn't
ever
to
be
stuccoed.
My
home
is
an
environmental
house
that
was
built
25
years
ago,
with
an
r-value
of
which
is
higher
than
the
houses
that
are
being
built
right
now.
The
house
was
designed
to
be,
and
it
is
a
little
different,
very
environmental
in
many
ways.

To
the
fence,
the
fence
and
I
apologize
for
this
I
really,
when
I
hired
a
landscape,
architect
believed
that
he
knew
acceptable
materials
I
do
find
the
materials
in
the
fencing
antiquated.
The
house
is
fully
grounded.
I've
sent
you
letters
which
I'm
sure
you
have
before
you
that
show
from
a
licensed
electrician,
a
licensed
architect,
a
licensed
other
landscape
architect
that
the
fence
is
grounded.
Each
panel
is
completely
encompassed
by
wood.
It
is
sunk
to
the
depth
of
the
legal
levels
which
does
ground
it,
so
that
part
is
done.

The
next
thing
is
I
live
on
a
ravine
system
where
the
my
property
is
the
last
flat
land.
It
then
sinks
as
most
ravines
do
into
different
movements,
and
it
radiates
quite
down.
The
fence
is
the
exact
height
that
the
fence
always
was
mr.
Varga
dose
erected
a
fence
illegally
against
my
deck
many
many
years
ago
the
fence
was
rotting.
The
deck
was
rotting
again.

the
fence
was
rotting,
the
deck
was
rotting,
I
had
to
take
it
down
for
safety,
I
erected
the
exact
same
height.
There
is
an
absolute
variance.
The
variance
is
due
on
his
property.
This
is
not
a
mutual
fence.
I
just
had
the
property
resurveyed,
and
it
is
three
is
on
my
side.
It
is
a
100%,
my
fence
as
to
anything
that's
under
the
fence.
I
cannot
access
the
fence
from
my
property.
So
if
there's
garbage,
it
was
certainly
not
me
who
put
it
there.

would
never
put
garbage
I
would
never
buy
and
make
an
environmental
house
to
put
garbage
down.
The
fence
is
also
recyclable
materials.
I'm
not
going
to
go
into
all
the
letters
that
you
already
have
before
you
again.
I
don't
need

be
redundant.
So

there's
any
questions

I
can
be
of

This
has
been
here
since
last
April
I,
believe
it's
been
in
front
of
this
committee
four
times
and
it's
now
time
to
make
a
decision,
because
I
think
that
keeping
this
at
bay
longer
by
another
deferral
would
not
be
good
for
either
of
the
neighbors.
This
is
a
very
contentious
fence
and
I've
received
some
correspondence
from
other
neighbors
that
are
fine
with
that
received
correspondence
from
the
law.

representing
the
family
and
I've
received
a
number
of
different
things
about
this
fence
really
and
truly
I've,
never
seen
so
much
correspondence
about
a
fence,
in
my
whole
time
on
Toronto
East,
York,
Community
Council.
These
aren't
easy
decisions
to
make,
but
I
believe
that
it
would
be
best.
I
am
convinced
and
I'll
tell
this
to
the
family,
the
regattas
family,
that
the
corrugated
metal,
as
our
staff
have
said,
is
safe
and
that
it
is
grounded
and
I
see
the
lawyer
shaking
his
head,
but
we
I
know
sir.

know
that
I'm
comfortable
with
that
advice
from
our
staff,
and
that
this
is
where
we
make
these
types
of
difficult
decisions.
So
I
will
be
moving
today
and
I
want
to
thank
everybody
for
their
patience
over
this
long
time
that
this
has
been
in
front
of
this
committee.

want
to
say
that
it
is
probably
leading
to
a
lot
of
frustration
and
anxiety
from
both
neighbors
because
it
hasn't
been
dealt
with
and
I
think.

very
unfortunate
that
this
was
brought
forward

to
this

direction

implement

forward

cities
and
you've
had
an
opportunity
to
work
for
work
with
them
and
do
consultation
and
arrive
at
a
set
of
dates.

this
event,

that

three

believe
in

We
subsequently

were
a
surrounding

there
was
positive
support
for
this
demonstration,
similar
very
similar
to
an
event.

recommendations

vision,
zero,
pop-up
demonstration
in
Ward,
19

I'd
like
to
thank
staff

all

their
work

less
conventional
initiative,
but
one
that
I
think
is
very
important.
The
event
will
be
at
the
end
of
August
the
weekend
from
August
22nd
set
up
on
the
Thursday,
the
Friday
August
23rd
Saturday,
and
take
down
on
Sunday
and

Think
it's
a
really
powerful
opportunity
for
us
to
demonstrate
as
a
city
how
we
can
use
a
range
of
different
design
interventions
to
make
our
streets
safer
for
everybody
and
doing
that
on
Danforth.
Right
now
is
really
important

I

emphasize
that
this
will
be
an
invitation
for
residents,
certainly
in
Ward
19
and
from
across
communities
in
Toronto,
to
come
and
see
what
a
complete
Street
looks
and
feels
like.

engagement

we

with

it
forward

changes

everybody
happy
the
date
and
other
assumptions
that
have
been
made
about
it.

bit

area

I

allows

parking
and
they
are
actually
fulfilling

requisites

front
of
us
is
because
they
need
51%
approval
and
they
only
got
50%.
Everything
else
is
fine.

the
green

have
everything
it's
because
of

fulfills
all

conditions

the

been

we

not
been
working
on
what
our
responses
for
to
the
media
instead
of
working
on
these
conditions,

we'll
